MEMORANDUM OF SQUIRE, SANDERS AND DEMPSEY OPPOSING MOTION OF CITY OF CLEVELAND FOR AN ORDER OF THE BOARD ENFORCING ITS ORDER OF DISQUALIFICATION I.

Although the City of Cleveland (City) captions its Motion as one seeking an order enforcing the Board's prior order of disqualification,

. . and asks for the same relief in its prayer, it hedges its bet by asking for certification and reconsideration.

" City now moves this Board to make effective the suspension of SS&D ordered by it on January 20, 1976, or in the alternative to certify the issues to the Atomic Safety and Licensing Board."

"Accordingly, this Board may now make its order effective or reconsider its order of suspension."

. Precisely what the City requests this Board do under the circumstances is shrouded - in ambiguity. Squire, Sanders and Dempsey -(SS&D) will assume, in responding, that the relief sought is spelled out in the caption and in the prayer; that is, an order making effective- the Board's prior order of sus-1

The City suggests that the language of $2.713(c), affording SS&D an opportunity to be heard, should be understood to provide a pro forma hearing only, with the result of the hearing to carry no weight. It suggests that the " sole purpose" of the second presiding officer "is to provide . . .

Squire, Sanders & Dempsey with an opportunity to be heard prior to the suspension or disbarment being made effective." These are incredible as-sertions when analyzed. Paraphrased they say, let's give SS&D a trial, then hang it. They suggest that the fact of the hearing rather than the result of the hearing is the critical consideration.

While the City may choose to characterize the Special Board's ruling as." advisory" the Special Board did not so regard it nor is there support for the City's characterization in the language of Rule 2.713(c) .

Of the six panel members considering the question of disqualification, four have held against it. To think seriously of suspending SS&D under these circumstances, and particularly in light of a unanimous ruling of the Special Board, is unimaginable.

III.

Both counsel for CEI and the City orally requested certification at the hearing of December 31, 1975. It was understood by counsel for SS&D that the Board would certify the question regardless of the ultimate decision at the hearing level. The comments of the majority appearing on pages 26

r and 27 of its Memorandum and Order appear to support this understanding.

SS&D interposes no objection to such certification if the City seeks it. However, it seriously objects to the ill-founded request contained in the instant motion.
