VIENS OF ILLINOIS REGARDING TPANSCRIPT Intervenor, People of the State of Illinois ( " Illinois ")

by William J. Scott, Attorney General in response to the March 28, 1980 Order of the Board requesting its views regarding the prehearing conference transcript states as follows:

1. The transcript of the special prehearing conference is of such poor quality as to be of minimal value in determining what really took place at the hearing. Portions of comments made by Counsel for Illinois have been omitted, other statements are misstated (some of them to such an extent as make the statement incomprehensible) and similar problems exist with the responses to Illinois' statements by both the Chairman and the other participants.
2. The simplest way to attempt to correct the transcript is to order that a new transcript be typed with copies distributed to all participants. Perhaps under the pressure of having to j produce daily copy the Court Reporters made mistakes that could be corrected by a more carefully typed version. A determination may then be made about the adequacy of the new transcript before we decide on more drastic measures.

3. The transcript as it presently exists does not adequately reflect the prehearing conference. However, before determing what should be done about the special prehearing conference a second transcript is an improvement over the first it may eliminate any need to consider other steps.

Illinois also suggests that the Board give consideration to engaging another court reporting firm in the future so that tbase problems are avoided.
