NORTHERN INDIANA PUBLIC SERVICE COMT ANY'S RENEWED MOTION FOR PROTECTIVE ORDER On June 29, 1981, " Porter County Chapter Intervenors" (PCCI) filed a Notice of Depositions of Allen H. Petersen, Forrest G. Hiple, and Carl R. Kulawinski, employees of Northern Indiana Public Service Company (NIPSCO). The stated dates for the depositions are September 9, 15, and 22, 1981, respectively.

NIPSCO advised counsel for PCCI that the specified employees would not appear and, on July 8, 1981, asked the Board to enter a protective order in view of NIPSCO's then-pending Motion for Establishment of Schedule.

On July 10 the Board issued its " Order (Closing Discovery)"

which requires that all depositions "be scheduled by August 28, Nevertheless, counsel for PCCI has served an Amended 4

1981."

Notice of Depositions (dated July 21, 1981) which identifies another reporting service but does not alter the dates previously specified for the depositions (i.e., September 9, 15, and 22).

Therefore NIPSCO again requests a protective order providing that the depositions of Messrs. Petersen, Hiple, and Kulawinski
