FEES FOR THE REmW OF THE ARIZONA PUBLIC SERVICE COMPANY CONSTRUCTION PERMIT APPLICATI0il This office has been advised that Arizona Public Service Cccpany withdrew their construction permit application for Palo Verde 4 & 5 on August 24, 1979, and by order dated September 27, 1979, the Atomic Safety and Licensing Board Panel dismissed the proceeding. Under the Comission's policy of cost recovery for the review of applications, we have examined the actual expenditures for professional manpower and contractual support services from the date the application was flied to the date of withdrawal of the application. Arizona Public Service should be billed for the costs of the review as follows:

$414,896 Cue Unit 2 Docket: STN 50-593 Fee Code: AA903 CCN Fee: $7,637 Even though the amounts indicated above are based on actual costs incurred, the Controller may want to consider putting the billing entry into a deferred account rather than the revenue account since the possibility exists that civil action in the U.S. Courts may be necessary to recover the costs. As you know, the Conaission billed two utilities for costs incurred for withdrawn applications (Irr.*oices 362-80 and 514-80) and the invoices remain outstanding. One utility has refused to pay. The Comission has been informed of this situation (SECY 80-364) and on Septeraber 4,1980 the Comission authorized the General Counsel to take acticn to recover the fees assessed.

Please notify this office when the total amount of $422,533 has been collected.
