v By letter dated October 27,1976 Ohio Edison Company'fiTed a construction permit application with the Commission to build two nuclear power plants near Berlin Heights.

Ohio. The plants were designated as the Erie 1uclear Plant. Units 1 and 2.

On January 23. 1980 Ohio Edison requested that NRC teminate any further proceeding, on the Constructica Permit Application for Erie 1 & 2 (Enclosure 1) and by order dated January 28, 1980 the Atoeie Safety and Licensing Board Panel dismissed the proceeding (Enslosure 2). The Camrission notified Ohio Edison on April 25, 1980 (Enclosure,1) that we considered the appifcation withdrawn.

In accordance with LFM established guidelines concerning the assessment of fees fbr withdrawn appitcations, we have reviewed the costs incurred by the various program offices from the date the appitcation was filed to the date of withdrawal of the applic:: tion. Enclosure' 4 is a suseery of the review costs as well as the supporting de=antation from the program offices. Enclosure 4 shows that there was a minimus-of $1.150,261 expanded for the review of Erie 1 and $16.208 expended for the review of Erie 2.

The application was filed and revfeued under the Commission's standardization progres (utility referencing a STD MSSS/ Custom 80P). Therefore, for purposes of assessing the costs of the Erie 1 & 2 review. we consider the CP fees in 10 CFR 170.21 A.4.a.

as the maximum allowable for recovery. The maximum that can be assessed for the review of Erie 1 is $978.600 ($125.000 + $853.600). The maximum to be assessed for the review of Erie Z is $162.500. Since the costs of the review for Unit i exceeds the noximum allowed. then $978.600 would be appitcable to Unit I while the costs of

$16,20d,which is below the 3162.500 allowed, would be applicable to Unit 2.

The total appitcable under the Consission's regulations for both units is 5994,808.

Since Ohio Edison paid an application fee of $125.000, this amount would be deducted from the total of 5994.808 leaving a balance due of $869.a08 for review of the Erie 1

& 2 application. We plan to notify the Office of Controller to bill Chfo Edison for the Casurisstas's cost of reviewing the withdrouc appifcation.

NOTICE OF WITHDRAWAL OF APPLICATION FOR CONSTRUCTION PERMITS AND FACILITY LICENSES On March 1,1977, the Nuclear Regulatory Commission docketed an appli-cation submitted by Ohio Edison Company on behalf of itself and The Toledo Edison Company, The Cleveland Electric Illuminating Company, Duquesne Light Company and Pennsylvania Power Company.

This application, filed pursuant to Section 103 of the Atomic Energy Act, requested authorization to construct and operate two pressurized water reacters, designated as Erie Nuclear Plants, Units 1 and 2, on a site located in Erie County, Ohio.

Notice of receipt of this application was published in the FEDERAL REGISTER on March 10, 1977 (42 FR 3363). The related notice of hearing was also published on May 16,1977 (42 F.R. 24775).

On January 23,1980, Ohio Edison Company requested the Atomic Safety and Licensing Board to terminate the hearing proceedings.

By order dated January 23, 1980., the Atomic Safety and Licensing Board dismissed the proceedings.

. Accordingly, the Cocrnission considers the application submitted by Ohio Edison Company to be withdrawn. Correspondence concerning this appli-cation will continue to be maintained at the Cocraission's Public Document Room,1717 H. Street, N.W., Washington, D.C.

For historical purposes only, selected matef_.ial will be retained at the Berlin Township Public Library,

As stated in 170.21 the maximum fee that can be assessed based on the above costs is $978,600 for Unit I and $16,208 for Unit 2.

Since only an application fee of

$125,000 has been paid, the balance due NRC is $869,808.

$869,808 N erb Berkow on May 22, 1980 stated that there was essentially no manpower expended in H

preparation for the hearing, despite the fact that the case was contested, since the case never got to the formal hearing stage.

2_/ Although Ohio Edison withdrew the application before a fomal hearing was held, ASLBP considered the case as contested up to the time of withdrawal of the application.
