SUBJECT:

FEES FOR THE REVIEW 0F THE ERIE 1 & 2 CONSTRUCTION PERMIT APPLICATION This office has been advised that Ohio Edison Co g any withdrew their construction pemit application for Erie 1 & 2 on January 23. 1980, and by order dated January 28. 1980, the Atomic Safety and Licensing Board Panel dismissed the proceeding. Under the Commission's policy of cost recovery for the review of applications, we have examined the actual expenditures for pmfessional manpcwer and contractual support services from the date the application was filed to the date of withdrawel of the application. Chio Edison should be billed for the costs of the review as follows:

Fee: $16.208 Even though the amounts indicated above am based on actual costs incurred, the Controller may want to consider putting the billing entry into a deferred account rather than the revenue account since the possibility exists that civil action in the U.S. Courts may be necessary to recover the costs. As you know, the Commission billed two utilities for costs incurred for withdrawn applications (Invoices 362-80 and 514-80) and the invoices remain outstanding. One utility has refused to pay. The Commission has been informed of this situation (SECY 80-3e4) and on September 4,1980 the Connission authorized the General Counsel to take action to recover the fees assessed.

Please notify this office when the total amount of $869.808 has been collected.
