SUBJECT:

GREENWOOD 2 & 3 CONSTRUCTION PERMIT REVIEW COSTS By letter dated June 4; 1973, Detroit Edison Company filed a construction permit application with the Commission to build two nuclear power plants in St. Clair County, Michigan. The plants were designated as the Greenwood Energy Center, Units 2 and 3.

Ort July 9,1980, Detroit Edison submitted its " Request for Withdrawal of Applf-cation" for Greenwood 2 & 3 (Enclosure 1) with the Atomic Safety and Licensing Board Panel (ASLBP) and by order dated July 14, 1980, the ASLBP dismissed the proceeding (Enclosure 2).

In accordance with LFMB estaS11shed guidelines concerning the assessment of

-fees for withdrawn applications, we have reviewed the costs incurred'by the various program offices from the date the. application was fiTed to the date of withdrawal of the application. EncTosure 3 is a stomary of the review costs as well as the supporting documentation fron the program offices. Enclosure 3 shows that there was $478,091 expended for the review of Greenwood:and $9,200 expended for the review of Greenwood 3.

The application was filed and reviewed by the Connission as a custon design.

Therefore, for purposes of assessing the costs of the Greenwood 2 & 3 review, we consider the CP fees in 10,CFR 170.21 A.1 as the maximum allowable for -

recovery. The maximum that can be assessed for the review of Greenwood 2 is

$T,069,000 ($125,000 + $944,000). The maximum to be assessed fon the review of Greenwood 3 is $174,000.- Since the costs of the review for both units are less than the maximum allowed, then $478,091 would be applicable to Unit 2 and $9,200 would be applicable to Unit 3.

The total applicable under the Comission's regulations for both units is $487,291. Since Detroit Edison paid an application fee of $70,000, this amount would be deducted from the total of $487,291 leaving a balance due of $417,291 for review of the Greenwood 2 & 3 application. We plan to: notify the Office of ControTler to bill Detroit Ed.ison for the Conmission's cost of reviewing the withdrawn application.

(" Applicant") was considering whether it would be appropriate to withdraw its Applica-tion for Licenses in this proceeding and request that the proceeding be terminated.

Applicant has now made a final decision to ask that the proceeding be terminated.

I am enclosing a formal request for withdrawal of application, which is subject to the approval of the Atomic Safety and Licensing Board under 10 C.F,.R. S 2.107.
