NINE MILE POINT NUCLEAR STATION - NRC SECURITY BASELINE INSPECTION REPORT 05000220/2018411 AND 05000410/2018411

Dear Mr. Hanson:

On October 18, 2018, the U.S. Nuclear Regulatory Commission (NRC) completed a security inspection at your Nine Mile Point Nuclear Station and discussed the results of the inspection with Mr. Robert Kreider, Plant Manager and other members of your staff. The results are documented in the enclosed report.

NRC inspectors documented one finding of very low security significance (Green) in this report.

This finding involved a violation of NRC requirements. The NRC is treating this violation as non-cited violation (NCV) consistent with Section 2.3.2.a of the Enforcement Policy.

One cross-cutting aspect was assigned to a finding in the area of Human Performance, Avoid Complacency. Specifically, Exelon failed to recognize and plan for the possibility of mistakes, latent issues, and inherent risk [H.12].

If you contest this violation or the significance of the NCV, you should provide a response within 30 days of the date of this inspection report, with the basis for your denial, to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555 0001; with copies to the Regional Administrator, Region I; the Director, Office of Enforcement; the Director, Office of Nuclear Security and Incident Response; and the NRC resident inspector at the Nine Mile Point Nuclear Station.

If you disagree with the cross-cutting aspect assignment in this report, you should provide a response within 30 days of the date of this inspection report, with the basis for your disagreement, to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington DC 20555-0001; with copies to the Regional Administrator, Region I; and the NRC resident inspector at the Nine Mile Point Nuclear Station.

This letter will be made available for public inspection and copying at http://www.nrc.gov/reading-rm/adams.html and at the NRCs Public Document Room in accordance with Title 10 of the Code of Federal Regulations (10 CFR) 2.390, Public Inspections, Exemptions, Requests for Withholding.

However, the enclosed report contains Security-Related Information; it will not be made publically available in accordance with 10 CFR 2.390(d)(1). If you choose to provide a response that contains Security-Related Information, please mark your entire response Security-Related Information-Withhold from public disclosure under 10 CFR 2.390, in accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390(b)(1). The NRC is waiving the affidavit requirements for your response in accordance with 10 CFR 2.390(b)(1)(ii).
