STATUS OF THE U.S. NUCLEAR REGULATORY COMMISSION OPERATING REACTOR REGULATORY AND LICENSING REVIEW PROCESSES In our letter dated June 13, 2013 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML13151A377), the U.S. Nuclear Regulatory Commission (NRC) alerted the industry to possible licensing review scheduling impacts stemming from the redirecting of staff to support the implementation of recommendations identified as a result of the events at the Fukushima Dai-chi nuclear power plant. At that time, the NRC actively assessed and redefined priorities and ensured that actions taken in response to Fukushima lessons-learned did not displace ongoing work that had greater safety benefit, work that was necessary for continued safe operation, or other existing high-priority work. Additionally, the NRC placed increased emphasis on the need for routine communications with licensees in order to foster a common awareness of project schedule expectations, as it related to safety significance and operational needs.
Initially, the redirecting of staff to address Fukushima lessons-learned resulted in a significant increase in the volume of licensing reviews requiring greater than 1 year to complete (i.e., the backlog). However, through the normalizing of the Fukushima workload and implementation of staffing and process changes, the NRC has since made significant improvements in our timeliness of completing licensing reviews, including notably reducing the backlog. As such, you should generally expect NRC staff to complete routine licensing reviews within 1 year and more challenging licensing reviews within 2 years. As you may be aware, the NRC's congressionally reported timeliness metrics are to complete 95 percent of submitted licensing reviews within 1 year and 100 percent within 2 years, unless the reviews meet specific exclusion criteria (e.g., license renewals, improved standard technical specifications conversions, power uprates, and unusually complex actions).
In addition to the measures discussed above that contributed to our successful backlog reduction, the NRC also implemented items associated with Project AIM and increased communications with the industry regarding future planned licensing action submittals. Along with these efforts, NRC management has placed additional emphasis with the staff regarding several key aspects of licensing reviews (ADAMS Accession No. ML16202A029) for which you, the industry, also play a key role in supporting the efficiency and effectiveness of future licensing reviews:
Pre-Submittal Meetings for "Complex" Licensing Actions - You should expect NRC Project Managers (PMs) to encourage you to participate in a pre-submittal meeting with the NRC prior to the submittal of any complex licensing action. The term "complex," in this context, is generally defined as those licensing actions that are first-of-a-kind, especially voluminous, require a broad range of technical review expertise on the part of the NRC, will likely be subject to review by the Advisory Committee on Reactor Safeguards, etc. It is recommended that you make every effort to actively participate in such meetings, including being prepared to discuss anticipated technical, licensing, and/or scheduling challenges. Issues discussed will be captured and provided to you in the pre-submittal meeting minutes generated by the PM. Although no regulatory decisions are typically made during a pre-submittal meeting, you should make every effort to ensure the technical and/or licensing issues raised are fully resolved and discussed in the subsequent submittal. You should also expect that the staff will ensure such discussions are included in the submittal during the acceptance review process.
Acceptance Reviews - You should expect the staff to closely adhere to established policies and practices regarding the acceptance review process, as discussed in Office of Nuclear Reactor Regulation (NRR) Office Instruction LIC-109, Revision 1, "Acceptance Review Procedures," dated July 16, 2009 (ADAMS Accession No. ML091810088). This includes the staff's timely completion of such reviews as well as an expectation that your submittals are complete, accurate, and sufficient to support the initiation of the staff's review. The staff will adhere to LIC-109, Appendix B, "Guide for Performing Acceptance Reviews," and Appendix D, "Guide for Performing Acceptance Reviews: Information Insufficiency Examples," when determining the sufficiency of licensing action submittals. You should expect the staff to consider non-acceptance for those cases where the staff has concluded that a submittal is not sufficient to begin its detailed review and for which a supplement, submitted within 13 days, would be required. Beginning in Fiscal Year 2017, the timeliness metric for licensing actions is changing to begin at the time of acceptance of an application rather than the point of receipt of the initial application.
Requests for Additional Information (RAls) - While it is expected that you submit high quality and complete submittals, the NRC will use the RAI process to obtain any supplemental information needed to make a final safety finding. You should typically receive no more than one round of RAls. However, in some cases additional information may still be required. To help with review timeliness and efficiency, you should expect PMs to actively seek opportunities to conduct an on-site audit or a public meeting in lieu of generating multiple rounds of RAls. Your continued diligence with timely and complete responses to RAls, and support of alternatives to RAls, will go a long way in supporting the timely closure of issues and completion of licensing action reviews.
Should RAI responses be untimely or substantially change the scope of the initially planned review (e.g., significant change in analytical methods), the staff will consider whether to deny, in part or in its entirety, or re-prioritize the application as significant slipping of schedules adversely impacts already established workload management processes and the completion of other previously planned and prioritized licensing work.
Workload Status Forecasting and PM/Licensee Communications - As you are already aware, the NRC issued Regulatory Issue Summary (RIS) 2015-16, "Planned Licensing Action Submittal for All Power Reactor Licensees," dated January 15, 2016 (ADAMS Accession No. ML16013A156), requesting you to provide information regarding planned licensing submittals over the next 3 calendar years and information on planned power uprate applications over the next 5 calendar years. This information provides an excellent baseline for expected licensing submittals and will significantly aid the NRC with its near-term resource planning efforts. Moving forward, you should expect at least monthly communications with your PM regarding the status of those planned licensing submittals, any new licensing actions, and any significant longer-term licensing actions.
The NRC will continue to work with you to identify opportunities to make the licensing review process as predictable, efficient, and effective as possible, consistent with the agency's mission to protect public health and safety and the environment. Activities such as the issuance of RIS 2015-16 and continued participation in periodic NEI Regulatory Issues Task Force (RITF) meetings will help ensure continued successes with these important reviews and help both the NRC and industry better manage necessary licensing resources.
