ACKNOWLEDGEMENT OF RESPONSE TO NOTICE OF VIOLATION (NRC INVESTIGATION REPORT NO. 1-2015-030)

Dear Mr. Simpson:

The purpose of this letter is to acknowledge receipt of your letter dated March 12, 2016 (ML16096A130) 1, in which you responded to the Notice of Violation (NOV) issued to you by the U.S. Nuclear Regulatory Commission (NRC) on February 16, 2016 (ML16047A026). The NOV related to your deliberate use of an illegal substance and performance of NRC-licensed activities at the Pilgrim Nuclear Power Station while under the influence of the substance, as indicated by a positive fitness-for-duty test administered to you by Entergy Nuclear Operations, Inc. on July 21, 2015.

The NRC staff has evaluated your response and determined that it acceptably describes why the violation occurred, the corrective actions taken and planned by you, and the date on which you came into full compliance with NRC requirements. Accordingly, the NRC plans no further action regarding this matter.

A copy of this letter and a redacted copy of your response dated March 12, 2016, will be made available electronically for public inspection in the NRC Public Document Room or from the NRCs document system (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html. These letters will be maintained by the Office of Enforcement (OE) in a NRC Privacy Act system of records, NRC-3, Enforcement Actions Against Individuals. The NRC-3 system notice, which provides detailed information about this system of records, can be accessed from our Web site at http://www.nrc.gov/reading-rm/foia/privacy-systems.html.
