SUMMARY
OF MARCH 19, 2015, CLOSED MEETING WITH FLORIDA POWER AND LIGHT COMPANY AND AREVA REGARDING SUPPLEMENTAL INFORMATION FOR THE LICENSE AMENDMENT AND EXEMPTION REQUESTS REGARDING THE TRANSITIONING TO AREVA FUEL (TAC NOS. MF5494 AND MF5495)
On March 19, 2015, a closed meeting was held between the U.S. Nuclear Regulatory Commission (NRC) staff and representatives of Florida Power and Light Company (the licensee) and AREVA at NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland. The purpose of the meeting was to discuss the licensee's proposed response to the NRC staffs supplemental information request provided by letter dated March 10, 2015 (Agencywide Documents Access and Management System (ADAMS)
Accession No. ML15055A473) for the proposed amendment and exemption request regarding the St. Lucie Plant, Unit No. 2 (SL-2) transition to AREVA fuel. This meeting was closed to the public due to the proprietary information that was discussed during the meeting. The meeting notice and agenda, dated March 13, 2015, are available in ADAMS at Accession No. ML15072A123. A list of attendees is enclosed.
During this meeting, proposed contents of the supplement and the planned schedule for its submittal were discussed. The licensee did not provide slides or make a presentation.
However, the licensee provided a draft copy of the proposed proprietary supplement to the meeting and discussed how it planned to respond to each item in the supplemental information request. The NRC staff asked the licensee if nonproprietary versions of the supplement will also be submitted along with the proprietary version, and the licensee indicated that when it submits the supplement, it will provide both proprietary and nonproprietary versions. The NRC staff reiterated to the licensee that no regulatory decisions would be made at the meeting. The NRC staff also reiterated that the licensee will need to provide more clarification than what was provided in the original application. Specifically, the amendment and exemption requests do not adequately provide justification for the use of AREVA methodologies for the control element assembly ejection accident and seismic analyses.
AREVA indicated that although SL-2 is a combustion engineering plant with a 16-by-16 fuel lattice array, AREVA's methodologies have been utilized by a wide array of fuel types (14-by-14, 15-by-15, and 17-by-17 fuel), and the proposed changes to SL-2 are considered similar.
However, the NRC staff indicated that the proposed fuel transfer to AREVA combustion engineering 16-by-16 fuel is an expansion of the applicability of existing topical reports and that applicability of the topical reports to the application will need to be followed up with requests for additional information, a potential audit, additional calculations, and detailed information from the licensee. The NRC staff also asked if the supplement will have more detailed explanations and tables, and the licensee indicated that it will provide more clarity.
The NRC staff asked if more detailed information will be made available beyond what has or will be submitted on the docket and the licensee indicated that information will be made available for a site audit as necessary.
The NRC staff asked the licensee if the special circumstances of the exemption request will be affected or if the no significant hazards consideration determination will be changed. The licensee indicated that it did not expect any changes, but if there are any, it will be indicated in the supplement.
The NRC staff asked the licensee to identify its expected path forward regarding whether the licensee will continue its plan to submit the supplemental information or if it plans to withdraw the application. The licensee indicated that it plans to submit the information by March 23, 2015, the due date. The NRC staff informed the licensee that once the supplement is received by the NRC, it will be reviewed, and the licensee will be notified whether the supplement will be accepted or not. If accepted, the NRC staff will notify the licensee and continue reviewing the application and the supplement, there will be requests for additional information, and there will potentially be an audit. If the supplement is not accepted, the licensee will be afforded the opportunity to withdraw the application, or the application will be rejected. The NRC staff also reiterated that due to the complexity of the license amendment and exemption requests, it may take longer than usual for the acceptance and detailed reviews to be completed.
