NOTICE AND ORDER (Scheduling Prehearing Conference Call and Notifying Parties of Amendments to Regulations)

The Board will convene a prehearing conference call on Wednesday, September 19, 2012, at 2:00 PM EDT to discuss the status of this proceeding.1 At least one counsel representing the Pacific Gas & Electric Co., the San Luis Obispo Mothers for Peace, and the NRC Staff shall participate in the conference call.

In addition, the Board notifies the parties that on August 3, 2012, the Nuclear Regulatory Commission amended its regulations related to Part 2 adjudicatory proceedings.2 Among other things, these amendments relax the rules regarding the Staffs mandatory disclosure duties and change the rules regarding the admission of new contentions. amendments apply to obligations and disputes that arise after the effective date. Id. at 46,562.

The effective date of the new regulations is September 4, 2012. Id.

Within 20 days of the service of this notice, the parties are instructed to submit written statements (joint or individual) specifying whether, in their opinion, the foregoing Part 2 amendments require or warrant any changes, additions, or deletions to the initial scheduling order or any other orders or instructions that this Board has issued governing the conduct of this proceeding. The submissions should include proposed language to implement such changes.

The parties should be prepared to discuss these proposals, and the impact of the Part 2 amendments, during the September 19, 2012 pre-hearing conference.
