SUBJECT:

UNIVERSITY OF UTAH - RETRACTION OF THE POWER UPRATE REQUEST FROM THE UNIVERSITY OF UTAH LICENSE RENEWAL APPLICATION (TAC NO. ME1599)

Dear Dr. Jevremovic:

The U. S. Nuclear Regulatory Commission (NRC) received your letter dated May 27, 2010 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML101600188), retracting the power uprate portion of your license renewal application (LRA) and requesting the LRA review under the existing power level of 100 kilowatts (kW) for Facility Operating License No. R-126, for the University of Utah TRIGA Reactor (UUTR). Since you are no longer requesting a power uprate, the NRC will review your LRA in accordance with the method described in the Interim Staff Guidance (ISG) on the Streamlined Review Process for License Renewal for Research Reactors (ADAMS ML092240244).

The NRC requests that you provide an updated safety analysis report, including technical specifications, consistent with a power level of 100 kW. Additionally, we ask that you continue work toward completion of the responses to the request for additional information (RAI) provided in NRC letter dated February 22, 2010 (ADAMS Accession No. ML100360411). However, since the RAIs were written to reflect the power uprate condition, a few changes are necessary: RAIs 39 and 60.2 are no longer necessary. Also, the power level referenced in RAIs 21.1, 21.2, 45.1, 59.6, and 60.1 should be changed from 250kW to 100kW.

If you have any questions, please contact me by telephone at 301-415-0893 or by e-mail at geoffrey.wertz@nrc.gov.

Sincerely,

/RA JQuichocho for/
