WATTS BAR NUCLEAR PLANT, UNIT 1 - POTENTIAL SCHEDULE IMPACT REGARDING REVISION OF TECHNICAL SPECIFICATIONS, "REVISION OF BORON REQUIREMENTS FOR COLD LEG ACCUMULATORS AND REFUELING WATER STORAGE TANK" (TAC NO. MD9396)

Dear Mr. Campbell:

The purpose of this letter is to inform you of a potential schedule impact on the Tennessee Valley Authority (TVA) proposed amendment request to revise the technical specifications for boron requirements for the cold leg accumulators and refueling water storage tank.

By letter dated August 1,2008 (ML082180093), TVA submitted the proposed amendment request and TVA requested completion of the proposed amendment by July 2009.

The U.S. Nuclear Regulatory Commission (NRC) staff had several discussions with TVA regarding this amendment. As a result, the NRC staff sent requests for additional information (RAI) regarding this application in letters dated October 14, 2008 (ML082831447),

October 28, 2008 (ML082940170), and November 7,2008 (ML083040104).

By letter dated November 25, 2008, (ML083360191 ),TVA responded to the NRC staff RAls dated October 14, and November 7,2008. The TVA letter did not provide information requested by the NRC staff in its RAls. Instead, the TVA letter dated November 25, 2008, indicated that TVA has elected to withdraw the supporting topical report and revise the methodology such that the NRC staff's RAI would not be applicable. TVA did not provide a schedule for submittal of the TVA new methodology and analyses. In a telephone discussion with the NRC staff on December 5,2008, TVA indicated that the revised submittal would be provided to the NRC staff on approximately January 5, 2009.

Additionally, in the RAI dated October 28, 2008, TVA agreed to provide RAI responses on December 12, 2008. The TVA letter dated November 25, 2008, indicated that TVA plans to submit the RAI responses consistent with the agreed schedule. However, in a telephone conversation with the NRC staff held on December 5,2008, TVA indicated that the RAI responses to the NRC staff RAI dated October 28,2008, will be provided along with the planned revised submittal to ensure that they are consistent with each other.

While the NRC staff will endeavor to complete its review of this proposed amendment request by the TVA requested date, the staff is unable to estimate the review effort involved until the supplement is submitted.
