ISSUANCE OF RENEWED FACILITY OPERATING LICENSE NO. DPR-59 FOR THE JAMES A. FITZPATRICK NUCLEAR POWER PLANT (TAC NO. MD2666)

Dear Mr. Dietrich:

The U.S. Nuclear Regulatory Commission (NRC) has issued the Renewed Facility Operating License No. DPR-59 for the James A. FitzPatrick Nuclear Power Plant (JAFNPP). The NRC issued the renewed facility operating license based on the staff's review of the JAFNPP License Renewal Application, dated July 31, 2006, as supplemented by your letters submitted to the NRC through November 5, 2007. The Technical Specifications for JAFNPP were not amended as a result of our review.

The technical basis for issuing the renewed license is set forth in NUREG-1905, ASafety Evaluation Report Related to the License Renewal of the James A. FitzPatrick Nuclear Power Plant,@ published in April 2008. The results of the environmental review related to the issuance of the renewed license are contained in NUREG-1437, Supplement 31, AGeneric Environmental Impact Statement for License Renewal of Nuclear Plants, Regarding James A. FitzPatrick Nuclear Power Plant,@ published in January 2008.

The Renewed Facility Operating License No. DPR-59 shall expire at midnight October 17, 2034.

Appendix A - ATechnical Specifications,@ and Appendix C - AAdditional Conditions.@ is a copy of the related Federal Register notice of issuance of the renewed license.
