REPLY TO A REQUEST FOR RECONSIDERATION OF THE NRC STAFFS DENIAL OF ENTERGY NUCLEAR OPERATIONS, INC.S, REQUEST FOR A COPY OF OFFICE OF INVESTIGATION REPORT NO. 1-2004-040 PRIOR TO AN APRIL 8, 2005, PREDECISIONAL ENFORCEMENT CONFERENCE

Dear Mr. Shapiro:

A preliminary enforcement conference (PEC) with Pilgrim Nuclear Power Station (PNPS) has been scheduled for April 8, 2005, in order to facilitate discussions regarding violations identified by the NRC after reviewing Office of Investigation (OI) Report No. 1-2004-040. This OI report concerned an incident on June 29, 2004, involving a control room supervisor sleeping while on duty. On February 23, 2005, PNPS requested a copy of the OI report.

Staff Requirements Memorandum - SECY-02-0166, Policy Options and Recommendations for Revising the NRCs Process for Handling Discrimination Issues, dated March 26, 2003, provides for the release of OI reports (with appropriate redactions and without the supporting documentation) for cases involving discrimination. Otherwise, procedures generally provide for the release of only the OI report synopsis or a factual summary. Accordingly, on March 8, 2005, the NRC Staff denied the licensees initial request for a copy of the OI report, and on March 23, 2005, a factual summary was provided to the licensee as an enclosure to the PEC letter.

By letter dated March 18, 2005, from Shaw Pittman, LLP, to the NRC Commissioners, Entergy Nuclear Operations (ENO) requested reconsideration of the NRC Staffs decision and requested that the Commission direct the NRC Staff to provide ENO with a copy of the NRC OI report prior to the scheduled April 8, 2005, PEC. The NRCs current policy, however, only addresses the release of redacted OI Reports to issues involving discrimination. Therefore, the staff will not release this OI report at this time. The agency intends to further consider the matter of whether or not it is appropriate to extend this policy to non-discrimination cases.

In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be made available electronically for public inspection in the NRC Public Document Room or from the NRCs document system (ADAMS).
