Calvert Cliffs Nuclear Power Plant Unit Nos. I & 2; Docket Nos. 50-317 & 50-318 License Amendment Request: Change Regarding Mode Change Limitations Using the Consolidated Line Item Imnrovement Process Pursuant to 10 CFR 50.90, Calvert Cliffs Nuclear Power Plant, Inc. requests an amendment to Renewed Operating License Nos. DPR-53 and DPR-69. The proposed amendment would modify Technical Specification requirements for mode change limitations in Limiting Condition for Operation 3.0.4 and Surveillance Requirement 3.0.4.

Attachment (1) provides a description of the proposed change including a table of affected Technical Specifications with a brief description of the change, the requested confirmation of applicability, and plant-specific verifications. Attachment (2) provides the existing Technical Specification pages marked up to show the proposed change.

We request approval of the proposed change as soon as possible and not later than February 1, 2006. No outage process is dependent on approval. We request an implementation period of 60 days.

DESCRIPTION AND ASSESSMENT

1.0 INTRODUCTION

The proposed amendment would modify Technical Specification requirements for mode change limitations in Limiting Condition for Operation (LCO) 3.0.4 and Surveillance Requirement (SR) 3.0.4.

The changes are consistent with Nuclear Regulatory Commission (NRC) approved Technical Specification Task Force (TSTF) Standard Technical Specification change TSTF-359-A, Revision 9 (Reference 1), which includes modifications noticed in the Federal Register published on April 4, 2003 (Reference 2). That Federal Register notice announced the availability of this Technical Specification improvement through the Consolidated Line Item Improvement Process (CLIIP).

This proposed change will allow mode changes while in an Action Condition if one of the following applies:

1. LCO 3.0.4.a - the Action has an unlimited Completion Time,
2. LCO 3.0.4.b - a risk analysis is performed, or
3. LCO 3.0.4.c - an Action containing a parameter has a note specifically allowing use of LCO 3.0.4.c.

3.0 TECHNICAL ANALYSIS

Applicabilitv of Published Safety Evaluation We have reviewed the NRC's Safety Evaluation dated April 4, 2003 as part of the CLIIP. This review included a review of the NRC staffs evaluation, as well as the information provided to support TSTF-359-A Revision 9. We have concluded that the justifications presented in the TSTF proposal and the Safety Evaluation prepared by the NRC staff are applicable to Calvert Cliffs Units I and 2, and justify this amendment for the incorporation of the changes to the Calvert Cliffs' Technical Specifications.

Except as identified below, the changes requested are identical to those in the TSTF-359-A, Revision 9 markup.

Optional Changes and Variations We are proposing the following variations or deviations from the Technical Specification changes described in TSTF-359-A, Revision 9 and the NRC staffs model Safety Evaluation dated April 4, 2003.

1. A change is proposed to an example provided in Section 1.4 "Frequency." Example 1.4-1 discusses what constitutes a violation of SR 3.0.4. This example should be clarified to acknowledge the existence of the two exceptions contained within the proposed SR 3.0.4.
2. A change is proposed to LCO 3.0.4.c to change "allowance" to "note." This change clarifies the wording as allowance can be confused with a numerical range.
3. In the added note to LCO 3.4.12, the Mode being entered is proposed to be Mode 3 vice the Mode 4 stated in TSTF-359-A, Revision 9. When the Calvert Cliffs Technical Specifications were converted to the Improved Standard Technical Specifications (ISTS), LCO 3.4.12 Applicability was established as Mode 3 with an RCS cold leg < 365 0 F (Unit 1) and < 301OF (Unit 2). Therefore, this new note is consistent with the current Calvert Cliffs Technical Specifications.
4. Calvert Cliffs has a note, that LCO 3.0.4 does not apply to Condition 3.7.3.A, that is not in the ISTS. We propose that note be removed. The global note that LCO 3.0.4.b does not apply is being added to LCO 3.7.3, as proposed in TSTF-359-A.
5. Calvert Cliffs has a note, that LCO 3.0.4 does not apply to Condition 3.7.3.B, that is not in the ISTS. We propose that note be removed. The global note that LCO 3.0.4.b does not apply is being added to LCO 3.7.3, as proposed in TSTF-359-A.
6. We request the addition of a note in LCO 3.8.1 prohibiting use of LCO 3.0.4.b for diesel generators except where otherwise noted. We are proposing the addition of notes to Required Actions 3.8.1.B and 3.8.1.E to allow use of LCO 3.0.4.b in Modes, 1, 2 and 3. Our diesel generator configuration allows more flexibility than considered in the owner's group risk evaluation (Reference 3).

DESCRIPTION AND ASSESSMENT Reference (3) states that the risk discussions related to diesel generators "are based on situations where TS DGs are the only source of emergency AC." Calvert Cliffs has two sources of emergency power, an independent off-site transmission network and emergency diesel generators.

These sources are required in Technical Specification 3.8.1.

In addition, Reference (3) states that, besides those plants with alternate AC sources, plants with emergency AC cross-ties "may have sufficient redundancy such that additional flexibility in relaxing mode restraints can be justified." Calvert Cliffs has a total of five diesel generators for two units. Four diesel generators are automatically aligned to safety-related busses. The fifth diesel functions as an alternate AC power source as it can be manually aligned to any safety-related bus on either unit.

The diesel generators are considered of high safety significance within Reference (3) because they support portions of the auxiliary feedwater (AFW) systems and safety injection systems. Of these two systems, the AFW system has the highest importance at Calvert Cliffs. The impact of the loss of the diesel generators on these systems is reduced at Calvert Cliffs primarily due to:

  • The common electrical systems at the 125 VDC level. With only one of the five diesel generators available, two of the four safety-related 125 VDC buses will be available. These buses can power one channel of control instrumentation and two channels of indication instrumentation for both units.
  • The diversity of the diesel generators. Our diesel generators are of two significantly different designs. This reduces the likelihood that all diesel generators will be lost due to some common mode failure.
  • The AFW configuration. Each unit has an AFW motor-driven pump that can be aligned to either unit (e.g., AFW pump 13 can support either Unit 1 or Unit 2).

Either of the two main buses can provide power to all safety-related buses. It would take multiple concurrent failures to cause the loss of both of the main buses in the switchyard.

  • The Southern Maryland Electric Cooperative 13 kV line. Independent of our switchyard is a separate offsite power supply that can be used to power one safety-related bus on each unit.
  • Minimizing switching of offsite power. We do not require transformer switching as the plant starts up.

We believe that our additional capacity beyond what is considered in Reference (3) allows additional flexibility in relaxing mode restraints for diesel generators. Therefore, the note added to Technical Specification 3.8.1 by TSTF-359-A, Revision 9 is modified in this proposal.

4.0 REGULATORY ANALYSIS

A description of this proposed change and its relationship to the applicable regulatory requirements and guidance was provided in the NRC Notice of Availability published on April 4, 2003 and TSTF-359-A, Revision 9.

Technical Specification Bases As discussed in the Notice of Availability published in the Federal Register on April 4, 2003 for this improvement, the Technical Specification Bases will be changed on approval of this proposed amendment 3

DESCRIPTION AND ASSESSMENT to conform with TSTF-359-A, Revision 9. The Bases will be modified to accommodate the deviations described in this letter.

Calvert Cliffs' Technical Specifications contain requirements for a Technical Specification Bases Control Program, consistent with the Bases Control Program described in Section 5.5 of the Combustion Engineering ISTS. The ISTS requirements of SR 3.0.1 and associated Bases are also contained in the Calvert Cliffs' Technical Specifications.

5.0 NO SIGNIFICANT HAZARDS CONSIDERATION DETERMINATION We have reviewed the proposed No Significant Hazards Consideration determination published in the Federal Register as part of the CLIIP. We have concluded that the proposed No Significant Hazards Consideration determination presented in the Federal Register Notice is applicable to Calvert Cliffs and is hereby incorporated by reference to satisfy the requirements of 10 CFR 50.91 (a).

6.0 ENVIRONMENTAL CONSIDERATION

Calvert Cliffs has reviewed the Environmental Evaluation included in the model Safety Evaluation dated April 4, 2003 as part of the CLIIP. We have concluded that the staffs findings presented in that evaluation are applicable to Calvert Cliffs and the evaluation is hereby incorporated by reference for this application.

7.0 REGULATORY COMMITMENT Calvert Cliffs will update the Technical Specification Bases as described above when this proposed license amendment is approved.

INSERT 1 When an LCO is not met, entry into a MODE or other specified condition in the Applicability shall only be made:

a. When the associated ACTIONS to be entered permit continued operation in the MODE or other specified condition in the Applicability for an unlimited period of time, or
b. After performance of a risk assessment addressing inoperable systems and components, consideration of the results, determination of the acceptability of entering the MODE or other specified condition in the Applicability, and establishment of risk management actions, if appropriate; exceptions to this Specification are stated in the individual Specifications, or
c. When a note is inserted in the individual value, parameter, or other Specification, that allows application of this part.

This Specification shall not prevent changes in MODEs or other specified conditions in the Applicability that are required to comply with ACTIONS or that are part of a shutdown of the unit.

INSERT 2 Entry into a MODE or other specified condition in the Applicability of an LCO shall only be made when the LCO's Surveillances have been met within their specified Frequency, except as provided by SR 3.0.3.
