SUBJECT:

SOUTH TEXAS PROJECT, UNITS 1 AND 2 - RE: PARTIAL WITHDRAWAL OF AN AMENDMENT REQUEST (TAC NOS. MC0823 AND MC0824)

Dear Mr. Sheppard:

By letter dated September 22, 2003, you applied for an amendment to Facility Operating License No. NPF-76 and Facility Operating License No. NPF-80 for the South Texas Project, Units 1 and 2, respectively. The proposed change would have modified the facility Technical Specifications (TSs) to change the requirements for the Engineered Safety Feature sequencer and the Surveillance Requirements that are applicable in Mode 5 and 6 to provide needed clarification. In addition, the proposed amendment would correct a typographical error from requirement c. in Technical Specification 3.2.4 to requirement b.. Subsequently, by letter dated September 30, 2004, you withdrew the amendment request except for that part of the request related to correction of the typographical error.

The Commission has filed the enclosed Notice of Withdrawal of Application for Amendment to Facility Operating License with the Office of the Federal Register for publication.

Sincerely,

/RA/
