Dear Mr. Barron:
By letter dated September 15, 2003, you requested exemptions from certain regulatory requirements related to the Duke Energy Corporation Physical Security Plan to support the use of mixed oxide lead test assembly fuel at the Catawba Nuclear Station. The Nuclear Regulatory Commission staff has reviewed that information and has determined that additional information is required as identified in the Enclosure.
The Enclosure contains Protected Information and pursuant to the Atomic Safety and Licensing Boards Order of December 15, 2003, (ASLBP No. 03-815-03-OLA) the Enclosure is not to be released to parties other than those specified in the Order, or those persons authorized to receive such information pursuant to Title 10 of the Code of Federal Regulations, Part 73.21(c)(1)(i). The Enclosure is also designated as Safeguards Information.
