NOTICE OF VIOLATION

,

Duquesne Light Company Docket Nos. 50 334,50-412 Deaver Valley Power Station 1 & 2 License Nos. DPR 66, NPF 73 During the NRC inspection conducted November 16 December 27,1997, a violation of NRC requirements was identified in accordance with the * General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG 1600, the violation is listed belcw:

A.

The Beaver Valiey Emergency Preparedness Plan, Section 7.1.4.2, provides that in the event the nearsite Emergency Operations Facility (EOF) is uninhabitable, it will be relocated to the Alternate EOF at Coraopolis, PA. Communications equipment, including direct telephone ;ines, is provided in the Alternate EOF.

10 CFR 50, Appendix E, Section IV.E.9, requires that all communication plans shall have arrangoments for emergencies, and that, where consistent with the function of the governmental agency, these arrangements willinclude:

a.

Provision for communications with contiguous State / local governments within the plume exposure pathway EPZ. S'ich communications s:.all be tested monthly, b.

Provision for communications with Federal emergency response organizations. Such communications systems shall be tested annually.

c.

Provision for communications among the nuclear power reactor control room, the onsite technical support center, and the near site emergency operations f acility; and among the nuclear f acility, the principal State and local emergency operations centers, and the field assessment teams. Such communications systems shall be tested annually.

d.

Provisions for communications by the licensee with NRC Headquarters and the appropriate NRC Regional Office Operations Center from the nuclear power reactor control room, the onsite technical support center, and the near site emergency operations facility. Such communications shall be tested monthly.

Contrary to the above, the licensee had not tested twenty of twenty seven direct lines at its Alternate EOF in Coraopolis, PA. These lines would be used to perform the functions described in Section IV.E.9.a-d of Appendix E in the event of an activation of that facility.

This is a Severity level IV violation (Gupplement Vill) applicable to Unit 1 and Unit 2.

Pursuant to the provisions of 10 CFR 2.201, Duquesne Light Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Regic a 1, and a copy to the NRr' Resident inspectors at the f acility that is the subject of this Notico, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if

violations, and (4) the date when full compliance will be achieved. Your response may reference or include previous docketed correspondence,if the correspondence adequately addresses the required response. If an adequate reply is not received within the time specified in this Notice, an order or a Demand for Information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.
