SOUTH TEXAS PROJECT ELECTRIC GENERATING STATION, NRC INSPECTION REPORT 05000498/2014408 AND 05000499/2014408 AND NRC INVESTIGATION REPORT NO. 4-2013-042
Dear Mr. Koehl:
This letter refers to the investigation conducted by the U.S. Nuclear Regulatory Commission's Office of Investigations, Region IV, at South Texas Project (STP) Electric Generating Station; Inspection Report 05000498/2014408 and 05000499/2014408 enclosed. The purpose of the investigation was to determine if there was a willful security-related violation at the STP Station.
Following notification by STP staff of a potential willful security-related violation the NRC initiated an investigation on August 14, 2013 that was completed on June 4, 2014. Based on the evidence developed during the investigation, the NRC concluded that a willful security-related violation occurred. A summary of this investigation is enclosed. The enclosed inspection report documents the inspection results, which were discussed on March 2, 2015, with Mr. A. Capristo, Executive Vice President and Chief Administrative Officer, and other members of your staff.
Based on the results of the inspection and investigation, the NRC has determined that a Severity Level IV violation of NRC requirements occurred. The NRC is treating this violation as a non-cited violation (NCV) consistent with Section 2.3.2.a of the Enforcement Policy. The NRC determined that a non-cited violation (NCV) is appropriate in this case because: (a) the violation was licensee-identified; (b) the violation involved the acts of an individual who was not considered to be a licensee official within the context of the NRC enforcement policy; (c) the violation appeared to be an isolated action of the employee without management involvement and was not caused by a lack of management oversight; and (d) you took appropriate disciplinary and corrective actions.
Since this violation is not being cited, a response to this letter is not required. However, if you contest the NCV or its significance, you should provide a response within 30 days of the date of this letter, with the basis for your denial, to the U. S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington DC 20555-0001; with copies to the Director,
