SUEJECT: TRANSMITTAL AND INVESTICATOR'S EVAI.UATION OF INVESTIGATION REPORT No. 50-338/77-3, 50-339/77-2 - NORTH A'iNA UNITS 1.U;D 2 Transmitted herewith is Investigation Report 50-33S/77-3, 50-339/77-2 (Enclosure 2), which presents the results of an investigation into allegations made by Sun Shipbuilding and Dcy D ck Ccepany (SUN) con-cerning VEPCO withholding information from the :3C relating to the design and repair activities involving the reactor ecolant pu=p and steam generator support structures at North Anna Units 1 and 2, and the investigator's evaluation of the significance of the findings (Encloaure 1).

Your attention is directed to the investigator's evaluation where it . is his opinica that VEPCO appears to be in violation of 10 CFR 50.55(e) for failure to report to the AEC/NRC the caterial in the report known as DC-81.

I concur ir this epinion.

As stated in paragraph IV,B.3 ' Conclusions) of the subj ect investigation report, the final deternina- ' tun of the requirement for reportability hinges on the legal significance of tSa ';f1mnuy and the extensiveness of evaluation, repair or design.
