This refers to the inspectica conducted en April 29, 1975, by Dssrs. L. L. Heratan and R. W. Wright of our Region II office of activities authorized by 57C Construction Permit Nos. CPPR-77 and CPPR-78 for North Anna !!uclear Plcnts, Units 1 and 2, and to the discussions of cur findings held with Mr. J. L. Perkins and others of your staff at the conclusion of the inspection.

Areas exa=ined during this inspection included the extent of settle =ent gf '

the Service. Water Reservoir Pumphouse for Units 1 and 2 and its impact on the safe operation of these facilities, recedial measures planned to arrest

the settle =ent, docu=entation relating to these settlenents, actions to assure that the pu=phouse for Units 3 and 4 would not settle in a similar canner, and to determine if the safety of the reservoir c=benk-ent has not been co= pro =ised.

Within these areas, the inspection consisted of selected examination of records, interviews with personnel, and observations by the inspectors.

e Based upon the results of this inspection, it appears that certain of your activities were not conducted in full ccepliance with NRC requirements as listed in the ::atice of Violation, enclosed herewith as Appendix A.

.'.s you are aware from the " Criteria For Determining Enforeccent Action," which was provided to you by our letter dated December 31, 1974, the enforcement actions available to the Co_aiasion in the exercise of its regulatory respon-sibilities include adninistrative acticas in the form of written notice of violation, civil uonetary penalty, and orders pertaining to the codification, suspension or revocation of a license.

After careful evaluation of the items of noncocpliance identified in appendix A, this of fice proposes a civil to Section 234 of the Atcaic Energy Act of 1954, as acended penalty pursuant of One Hundred (42 USC 2282) and 10 CFR 2.205, in the cumulative c=ount and Four Thousand Dollars ($104,000) as set forth in the ":*otice of Preposed I= position of Civil Penalty," enclosed herewith as Apper. dix C.

The item of noncompliance identified in Appendix A is the failure to report l

in a ticely manner the settlement of the Service Water Reservoir Pu=phouie for Units 1 and 2, a seismic Class I structure, and the associated settlement of the reservoir embank =ent which ties into the pu=phouse.

This item of acace pliance relates to the adequacy of design and construction of this facility and could, if not detected and corrected, have adversely affected the Sealth and safety of the public.

It is therefore, considered to be of cajor significance.

To acet the criteria cnd bcaes stated in the safety analysis report or construction permit or to otherwise establish the cdequacy of the structure, system or ce=ponent to perform its intended rafety function.

Page S2.10-3 of the PSAR dated June 16, 1970, establishes the total snticipated settle:ent of the Service Water Reservoir Pumpbouse (SW?H) at 0.12 feet.

Settle ent of the SW?H exceeded the anticipated cnd VEPC0 recorded the settIccent on February 12-13, 1973, as 0.03 feet on the SE corner, 0.11 feet on the RW corner, 0.158 feet on the NE corner, and 0.24 feet on the NW cerner.

From the plot of settlement ressurenents, it appears that the excessive settlement was known by VEPC0 as early as Deccuber 5, 1972.

Centrary to the 10 CFR 50.55(e) require =ents, SWPH settle ent in excess of safety cnalysis report criteria was not reported prc=ptly to the Regica II office cnd a vritten repott was not submitted within 30 days to the Director, Office of Inspection and Enforce:ent.

This infraction was identified by the licensee and constitutes an 1 occurrence with safety significance.
