office-in Walnut Creek, California, with the individuals listed in f, paragraph 1-abovedn attendanc > ,

The Regional Administrator opened the meeting with the statement that it appeared that several problems were. identified during a recent inspection of the licensee's emergency preparedness program and that this meeting was an opportunity to understand the facts and circumstances surrounding the inspection findings. The Regional Administrator then turned the t'

'. . g-L, l meeting over to the Director, Division of Radiation Safety and Safeguards, who reviewed the licensee's history in the area of emergency preparedness. The Division Director noted.that the licensee's own audits L had identified problems with. emergency preparedness training spanning the past few years. The Division Director also noted that Rancho Seco ha received a SALP category 2 rating :with an improving trend, during the last evaluation period.

Following the Division Director's presentation, the emergency preparedness inspector summarized the three apparent' violations identified during her inspection. After each one of the apparent violations was presented, the licensee was. asked if they had any comments with respect to the accuracy of the' findings as presented. The licensee representatives commented that the findings supporting the apparent violations and the information presented.in the inspection report were factua The licensee was provided with an opportunity to make a formal respons The licensee's presentation described the District's preliminary assessment of the problems and the planned corrective actions as noted in their handout, Attachment 1. During the introduction, SMUD's Assistant

General Manager.(AGM), Nuclear, stated that the training problems stemmed from inadequate training documentation and that, in his opinion, the

" individuals assigned to the active Emergency Response Organization (ERO)

could have performed their jobs in an acceptable manner if it had been

, necessary. -In spite of this opinion, the AGM expressed his concerns that

< the training had not.been completed and that the problems resulted from a lack'oftmanagement controls. He also indicated that he was disturbed to d' _be one of,the individuals lacking the prescribed training since he

l The licen'see's assessment of the problems was divided into two areas: (1)

Lthe failure to conduct the semi-annual health physics drill, and (2) ERO maintenance and training. The following paragraphs are intended to summarize the information provided by the licensee in the two

aforementioned area '

. rehearsal and the lack of management controls as the reasons for missing the dril The licensee stated that a health physics drill has now been

scheduled for September 27, 198 Regarding the maintenance and training of the ERO, the licensee acknowledged that the emergency preparedness staff recognized that staffing problems existed in May 1989 and that, as a result, they initiated a weekly review of the ERO. Further, the licensee acknowledged the training documentation problems and admitted that the documentation problems were associated with the completion of the training exemptions that are issued to individuals who participate in drills and exercises.

" designees" in the ERTD, but that, at the time, he was not aware that-

assigning " designees" to the essential list was inconsistent with the _

emergency plan implementing procedures (EPIPs). As used by the. licensee,

" designees" signify individuals not fully qualified for their emergency response duties in accordance with EPIP-560 At.this point in the licensee's presentation, the Manager, Environmental Monitoring and Emergency Preparedness (EM&EP), was asked to comment on this decisionmaking process. The EM&EP Manager stated that his major i concern was to keep an adequate level of staffing for'the essential l positions in the ERO and that he made.a conscious decision to add '

individuals to the.ERTD, without first verifying their training statu He stated ~that the status of the training documentation had a bearing on  !,

this. decision and that he thought it was better to have individuals  !

identified, based on.their experience and expertise, than to have a list - .,

with empty positions due to incomplete training. The EM&EP Manager i further stated that he had the individuals placed on the list as alternates,'with the intention to catch up on the training when time permitted. .The Deputy AGM stated that although they felt that most o j the individuals could have performed their duties, they could not make that guarantee for all of the individual Following the above conversation, the licensee described-'their planned corrective actions. These corrective actions included bringing the ERO ,

training current and to issue an ERTD that clearly identifies active and I non-active personnel. The licensee indicated that the essential ERD l training was complete with the exception of one individual. Also, the i licensee stated that they intended to proceduralize the data transfer, i control and use of the training and ERO database l The staffing of th'e emergency preparedness organization was also j discussed. The licensee stated that destaffing in the emergency preparedness department was based on.the potential.for receiving an exemption from the annual emergency exercise requirement. The licensee  !

acknowledged that their closure plan identified the need to restaff this '

' area if the NRC did not grant the exemption. The licensee indicated that the problems that were identified represented a lack of management i control and that they were not just; caused by a lack of resources since i they began before the June election. The licensee was asked to comment on their ability to complete train ~ing with the reduced staff levels in emergency preparedness. The AGM stated that they had miscalculated the number of individuals needed in the area of emergency preparedness and that the reduced staff levels had an impact on their ability to recover from the previously' identified training documentation problem Accordingly,2the licensee stated that they had issued an across the board

had been one area that was cut back too far, too fas The next topic discussed was the licensee's. September 13, 1989,- response tolthe~NRC's September 6, 1989, 50.54(f)' letter. The-scope of this discussion centered on the need to conduct a controlled closure and that the process needed to t,e handled in a formal manner. The area of emergency preparedness was identified by.the AGM as the only issue to be resolve The NRC Enforcement Officer.then_briefly addressed the NRC Enforcement-Policy.

l- -In closing remarks, the Regional Administrator commented that he was

. satisfied that the licensee'was acting satisfactoril He reminded the

' licensee that the area of emergency preparedness has a high profile in

' terms of_ safety significance and that now is not'the time to relax. He further stated that if the licensee requests relief in certain areas, l these requests would be considered in' a reasonable manner, with the public's interest considered.
