EXERCISE OF ENFORCEMENT DISCRETION FOR SALEM SSFI TEAM INSPECTION FINDINGS AND MARCH 6, 1997 MANAGEMENT MEETING ON SALEM UNIT 2 LICENSING/DESIGN BASES
Dear Mr. Eliason:
This letter pertains to the regulatory conclusions associated with several findings from the U. S. Nuclear Regulatory Commission (NRC) Safety System Functional Inspection (SSFI) llt Salem Unit 2, and a management meeting held on March 6, 1997. NRC Inspection Report (IR) 50-3j 1 /96-81 that identified these findings was previously sent to you on January 21, 1997.
At the meeting conducted on March 6, 1997, you presented the results of your actions to assess compliance of Salem Unit 2 with its licensing and design bases (LB/DB). In particular, we discussed your conclusion that Unit 2 was ready for restart from a LB/DB perspective. We also discussed the impact of the NRC's recent safety system functional inspection of the component cooling water system (IR 96-81), and the prominent findings such as component cooling water pump and ventilation functionality (LER 96-37) in the context of your larger LB/DB conclusion. A copy of your presentation slides and a transcript of the meeting are attached to this letter.
Two additional issues were discussed at the March 6 meeting. For the first issue, the NRC requests further discussion and supplemental information on the status of PSE&G's evaluation of Generic Letter (GL) 96-01, "Testing of Safety-Related Logic Circuits,"
specifically your commitment to complete this evaluation by December 31, 1997.
Regarding the second issue, the NRC has received and is currently reviewing your letter of April 10, 1997 (LR-N970219) providing PSE&G's basis for deferring the completion of Phase 2 of the Technical Specification Surveillance Improvement Program (TSSIP) until after Salem Unit 2 restart.
In IR 96-81, 15 unresolved items (URls) were identified that were candidates for l I enforcement actions. The NRC has concluded that several of these items involving design J {
cJ j deficiencies associated with the component cooling water system (URls 50-311/96-81-01-02, 03, and 08), represented violations of NRC requirements. These violations are not being cited in accordance with the criteria of Section Vll.B.2 of the NRC Enforcement Policy, principally because they stem from licensed activities prior to the shutdown period and have since been addressed by broad comprehensive PSE&G programs underway at 9705200022 970508 PDR ADOCK 05000311 G

Mr. Leon Salem to identify and correct such problems. This decision has been coordinated with the Office of Enforcement. The NRC staff will review your specific corrective actions for these items during future inspections. Disposition of the remaining 11 URls requires further NRC review. As subsequent issues develop from further NRC inspection or.PSE&G problem identification efforts, the NRC will continue to assess them for their applicability to the overall LB/DB conclusion for Salem.
In accordance with 10 CFR 2. 790 of the Commission's regulations, a copy of this letter and its enclosures will be placed in the NRC Public Document Room.
