UNITED STATES NUCLEAR REGULATORY COMMISSION Region III 2443 Warrenville Road, Suite 210 Lisle, IL 60532-4352 February 12, 2014 EA-13-210 Mr. Kevin Davison Site Vice President Prairie Island Nuclear Generating Plant Northern States Power Company, Minnesota 1717 Wakonade Drive East Welch, MN 55089 SUBJECT: NOTICE OF VIOLATION - PRAIRIE ISLAND NUCLEAR GENERATING PLANT; CLOSURE OF NRC INVESTIGATION 3-2013-017; NRC REPORT NO. 05000282/2013407; 05000306/2013407 On May 2, 2013, the U.S. Nuclear Regulatory Commission's Office of Investigations (OI),

Region III Field Office, initiated an investigation into an event that was reported to the NRC by Prairie Island Nuclear Generating Plant personnel in their official capacity. The investigation was completed on October 4, 2013, and was documented in OI Report No. 3-2013-017.

Based on the information developed during the investigation, the NRC has determined that a violation of NRC requirements occurred. The violation is cited in the Notice of Violation (Notice)

in Enclosure 1 (Non-Public) and the basis for our conclusion is described in Enclosure 2 (Non-Public).

Because the NRC determined that the actions were willful on the part of one of your employees, the NRC evaluated whether the criteria for issuing a non-cited violation in Section 2.3.2.a.4 of the NRC Enforcement Policy were met. The NRCs review of the investigation results determined that a cited Notice was the appropriate action to take for the reasons discussed in Enclosure 2 and as stated during the telephonic exit meeting on January 28, 2014.

You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. We would especially appreciate your addressing changes in training and management expectations as a result of this event. If you have additional information that you believe the NRC should consider, you may provide it in your response to the Notice. The NRC review of your response to the Notice will also determine whether further enforcement action is necessary to ensure compliance with regulatory requirements. Please mark your entire response Security-Related Information - Withhold from Public Disclosure under 10 CFR 2.390 in accordance with Title 10 of the Code of Federal Regulations (10 CFR) 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390(b)(1).
