Subject: Notice of Violation (NRC Inspection No. 50-277/84-19 and 50-278/84-10)

This refers to the special inspection conducted by Region I staff members on June 25-29 and July 11, 1984, at the Peach Bottom Atomic Power Station, Delta, Pennsylvania', of activities authorized by NRC License Nos. DPR-44 and DPR-56.

- The inspection report was forwarded to you on July 25, 1984.

During the inspection, several violations of NRC requirements were identified.

On July 31, 1984, we held an enforcement conference with you and members of your staff during which these violations, their causes, and your corrective actions were discussed. As a result of the enforcement conference, several of the violations identified in the inspection report, dated July 25, 1984, have been resolved.

The remaining violations have been categorized in the aggregate as a Severity Level III problem to focus on the apparent underlying cause; namely, inadequate supervision of the physical protection program. Civil penalties may be con-l sidered for Severity Level.III violations or problems. However, we have decided not to propose a civil penalty in this case because of your past good performance g

in the area of the physical protection program as evidenced by a Category 1

rating during the last Systematic Assessment of Licensee Performance.

Further, examination of the four security program related violations identified over the

last eighteen m5nths did not reveal any precursor events that we believe should have led your organization to preventing the violations identified during this inspection. We will cicsely examine your corrective actions and we emphasize that similar violations in the future may result in additional enforcement ac-tion.. After consultation with the Director, Office of Inspection and Enforcement,

In your response, you should describe the action taken or planned to avoid similar violations in the future. Your written reply to this letter and the results of future inspections will be considered in determining whether further enforcement action is appropriate.

Sections of the enclosure contain details of your security program that have been determined to be exempt from public disclosure in accordance with either 10 CFR 73.21-(Safeguards Information) or 10 CFR 9.5(a)(4) (Commercial or Financial Information). Therefore, the sections so identified will not be placed in the NRC Public Document Room and will receive limited distribution.

The responses directed by this letter and the enclosed Notice are not subject to the clearance procedures of the Office of Management and Budget, as required by the Paperwork Reduction Act of 1980, PL 96-511.
