NOTICE OF VIOLATION Philadelphia Electric Company Docket Nos. 50-277; 50-278 Peach Bottor Atomic Power Station License Nos. DPR-44; DPR-56 1

EA No. 84-94 On June 25-29 and July ll,1984, the NRC conducted an inspection of the physical protection program at Peach Bottom. During the inspection, several violations were identified. The violations demonstrate the need for improved supervision of the program and have been categorized in the aggregate as a Severity Level III problem. Although civil penalties are considered for Severity Level III violations or problems, a civil penalty is not proposed in tnis case because of the licensee's past good performance in this area; in particular, a Category I rating during the last Systematic Assessment of Licensee Performance by the NRC.

In accordance with the-NRC Enforcement Policy (10 CFR 2, Appendix C), the individual violations are set forth below:

10 CFR 50.54(p) requires that the licensee make no change to his security program which would decrease the overall effectiven.ess of the security plan without the approval of the Commission. The licensee may make changes to the security plan without prior approval of the Commission provided the changes do not decrease the safeguards effectiveness; however the licensee must furnish the NRC a report containing a description of each change within two months after the change is made.

Paragraph 13.4 of the Plan states, in part, " Alarms, intrusions or other security incidents which require the dispatching of a plant security force member are recorded in either the security computer file, security force log or control operators' log."

This plan provision implements the requirements of 10 CFR 73.70(f), which states, in part, that details of the response by facility guards and watchmen to each alarm, intrusion, or ot.her security incident be recorded.

Contrary to the above, on June 26, 1984, information recorded in the security computer file, security force log and control operators' log was incomplete in that the recorded details of the alarm response by security personnel were insuf ficient to permit & determination of the cause of the alarms or whether the alarm situation had been effectively neutralized.

These violations have been categorized in the aggregate.as a Severity Level III problem.

Pursuant to the provisions of'10 CFR 2.201, Philadelphia Electric Company is hereby required to submit to this office within 30 days of the date of this Notice, a written stateme'nt or explanation, including for each alleged viola-tion:

(1) admission or denial of the alleged violation; (2) the reasons for the violation, if admitted; (3) the corrective steps which have been taken and the results achieved; (4) the corrective steps which will be taken to avoid further violations; (5) the date when full compliance will be achieved.

Consideration may be given to extending the response time for good cause shown.
