e Governor White has requested that I respond to your letter and that of your daughter regarding employment protection of employees who reauest or participate in activities provided for by the Atomic Energy Act of 1054.
As you know, s'everal nuclear power plants and numerous other nuclear facilities are being or may be constructed in the State of Texas. Because of the construction of those facilities, the Governor is very concerned that the revelant federal laws and agency statutes fully protect individuals who come forward and report or other-wise participate in activities designed to ensure proper construction and operation of nuclear facilities in the State. As a result of your letters, I have undertaken a review of the revelent statutes and regulations as well as key portions of the record relating to your husband's particular case.
Preliminary review of the r.aterials mentioned above indicates .that the Nuclear Regulatory Comission has complied with the recuirements of Section 2.10 of the Atocic Energy Act of 1954 as amended and with relevant portions of their regulations.
It would seem that the law and regulations cited r.ay not provide sufficient protec-t i o r. . Any change in federal law would, of course, have to be initiated in Congress.
You may wish to write to your congressman if you have not done sc. '
I fully agree that individuals co m.itted to careful and safe construction and operation of these complex facilities should be afforded maximurt protectior, under the law. I sincerely appreciate your having called this situation to our attention, i although,unfortunately we are not in a position to offer any assistance.
