Dear Sir or Madam:

Pursuant to N.J.A.C. 7:14A-6.10(j), PSEG Nuclear LLC ("PSEG Nuclear") is submitting this written report to the New Jersey Department of Environmental Protection ("NJDEP" or "Department"),

concerning non-compliance reporting at the Hope Creek Generating Station ("Hope Creek" or "the Station"). Hope Creek is located in Lower Alloways Creek, Salem County, New Jersey. This letter is being delivered at the same time as the discharge monitoring report (DMR), which is being submitted to the Division of Water Quality.

As stated more fully within this report, PSEG Nuclear was informed in April, 2007 that South Jersey Testing Laboratories ("SJTL"), located at 1170 Karin Street, Vineland, New Jersey, the contract laboratory for Hope Creek's NJPDES compliance, was not certified for.the testing and analysis of Total Petroleum Hydrocarbons ("TPH"), and had not been certified to do so since July, 2005. PSEG Nuclear reported the potential violation to the NJDEP in April 2007. As stated below, PSEG Nuclear has corrected this situation, and believes there has been no impact to human health or the environment.

Further, to the extent that there was a violation, PSEG Nuclear believes that the incident falls within the definition of a laboratory error and, accordingly, is entitled to an affirmative defense. Therefore, PSEG Nuclear is also submitting a request for an affirmative defense pursuant to NJ.A.C. 7:14-8.3(i).

1. DESCRIPTION OF INCIDENT This incident involves the failure of SJTL to provide certified results to PSEG Nuclear for TPH.

By way of background, PSEG Nuclear has utilized SJTL for over 15 years to analyze samples from its discharge points as part of the company's compliance with its Hope Creek NJPDES permit. In April, 2007, PSEG Nuclear began receiving analytical results with a footnote next to the analysis for TPH indicating that it was for information only. When PSEG Nuclear contacted SJTL to request an explanation, SJTL explained that it was not a certified laboratory for TPH. PSEG Nuclear did not learn this until April 26, 2007. Fortunately, PSEG Nuclear had sent a duplicate sample to QC Laboratories

("QC"), located in Southampton, Pennsylvania, a laboratory certified by NJDEP to perform TPH analysis.

PSEG Nuclear was able to have QC perform an appropriate analysis for TPH, which is indicated on the April 2007 DMR.'

PSEG Nuclear immediately required SJTL to provide a timeline and explanation of its lack of certification. After making this inquiry, SJTL responded that it had not obtained certification from NJDEP as required in 2005. Based upon conversations with the NJDEP Office of Quality Assurance, and with SJTL, it is PSEG Nuclear's understanding that NJDEP did not begin requiring laboratories to become certified for TPH analysis until Fiscal Year 2006. Although SJTL claims that it had applied for certification at that time, SJTL now indicates that it had not obtained such certification. Thus, PSEG Nuclear believes that SJTL may have been uncertified for TPH analyses since July, 2005. However, PSEG Nuclear did not learn about SJTL's lack of certification until the footnote mentioned above appeared on the March/April 2007 analytical report, and PSEG Nuclear contacted SJTL on April 26, 2007 to obtain further explanation of the footnote. Previous SJTL analytical results did not have such a footnote. While this matter continues to be investigated by PSEG Nuclear, the company is unaware of any prior notice received from SJTL that the laboratory was not certified by NJDEP for TPH analysis.

Attached hereto as Attachment A are SJTL analytical results from April 2007 which include the aforementioned footnote.

On April 30, 2007, PSEG Nuclear telephoned Steve Mathis of the Southern Regional Enforcement office, and e-mailed Susan Rosenwinkel, the permitting officer in the Division of Water Quality to advise them of the potential lack of certification by SJTL. PSEG Nuclear also notified Rachel Ellis in the Office of Quality Assurance on April 30, 2007.

2. STEPS BEING TAKEN TO DETERMINE THE CAUSE OF THE INCIDENT PSEG Nuclear has determined that the cause of the submission of uncertified TPH results is due to SJTL not informing PSEG Nuclear of its lack of certification.
3. STEPS BEING TAKEN TO REDUCE, REMEDIATE AND ELfMINATE TUE INCIDENT AND ANY DAMAGE TO THE ENVIRONMENT PSEG Nuclear immediately began using QC to conduct certified analyses previously conducted by SJTL. Attached hereto as Attachment B is evidence that QC is certified for TPI-. In addition, PSEG Nuclear has suspended utilizing SJTL until it has completed its investigation and determined a further course of action.

PSEG Nuclear believes that the incident caused no threat to human health or the environment.

Since July 2005, SJTL has indicated on its monthly analytical reports that it has utilized Method 418.1 to analyze the samples for TPH. Method 418.1 has been, and is to date, the appropriate method for such analysis. A copy of SJTL monthly analytical results indicating use of Method 418.1 from July 2005 to March 2007, is attached as Attachment C. The analytical results reported by SJTL for TPH during the period when SJTL was not certified for the parameter did not indicate any exceedences. Further, the analytical result from QC did not indicate an exceedence for TPH for the samples it analyzed.

4. DURATION OF THE INCIDENT PSEG Nuclear began submitting spilt and duplicate samples to QC in April 2007 as a result of issues related to potable well monitoring. The split and duplicate samples included samples for both wastewater discharges and drinking water.

To the best of PSEG Nuclear's knowledge, SJTL's failure to be certified for TPH analysis began in July 2005.

5. CAUSE OF THE INCIDENT See response to item 1, above.
6. STEPS BEING TAKEN TO REDUCE, ELIMINATE AND PREVENT THlE RECURRENCE OF THE INCIDENT PSEG Nuclear has suspended the use of SJTL until further notice, and has begun utilizing other certified laboratories, including QC, to provide certified analyses for the Hope Creek NJPDES permit compliance monitoring.
7. ESTIMATE OF TUE THREAT TO HUMAN HEALTH AND TIE ENVIRONMENT See response to item 3, above.
8. MEASURES TAKEN TO REMEDIATE THE PROBLEM AND ANY DAMAGE OR INJURY TO HUMAN HEALTH OR TUE ENVIRONMENT, AND TO AVOID REPETITION OF THE PROBLEM As previously explained in response to item 3, above, PSEG Nuclear does not believe any remediation is necessary since the company believes there is no damage or injury to human health or the environment.

In order to prevent submission of uncertified laboratory results in the future, PSEG Nuclear is reviewing its procedures to provide additional assurance that a laboratory is certified and that if a laboratory loses its certification, either in whole or in part, that notification procedures are in place to allow PSEG Nuclear to change laboratories to maintain certified results. Such changes in procedures may include contract provisions that require submittal of current certifications for the analyses included in the contract before any of those analyses are performed, and immediate notification when the status of any certification changes.

AFFIRMATIVE DEFENSE OF LABORATORY ERROR In addition to the information provided above, and pursuant to N.J.A.C. 7:14A-6. 11 and N.J.A.C.

7:14-8.3(i), PSEG Nuclear submits the following information to substantiate the bases for the company's entitlement to an affirmative defense:

1. The laboratory error was not caused by operational error, improperly designed treatment facilities, inadequate treatment facilities, lack of preventative maintenance or careless or improper operation or maintenance. Hope Creek was operating in accordance with the Station's Standard Operating Procedures. Further, SJTL did not indicate to PSEG Nuclear that it was not certified for TPH until April 2007.
2. This report satisfies all provisions of N.J.A.C. 7:14A-6.10.
3. The incident was not related to a groundwater remedial action.
4. SJTL was solely responsible for obtaining certification, and did not do so. To the extent that SJTL did not obtain certification for TPH, the laboratory should have put PSEG Nuclear on

notice imnediately so that PSEG Nuclear could have utilized a certified laboratory to perform TPH analyses.

As set forth above, PSEG Nuclear has satisfied the requirements for asserting an affirmative defense of laboratory error at Hope Creek Generating Station for all analytical results for TPH from July 2005 until March 2007.
