Ladies and Gentlemen:

On July 23, 2009, Carolina Power & Light Company (CP&L), now doing business as Progress Energy Carolinas, Inc., requested a revision to the Technical Specifications (TS) for the Brunswick Steam Electric Plant (BSEP), Unit No. 1. The proposed license amendment would revise TS 5.5.12, "Primary Containment Leakage Rate Testing, Program," to add an exception for leakage testing associated with a modification being made to the Unit 1 X-2 primary containment penetration sleeve.

Based on discussions between the NRC and CP&L, it is apparent that post-modification leakage testing alternatives would more appropriately be sought as a 10 CFR 50.55a alternative (i.e., relief request) rather than a license amendment request, and that additional technical information supporting an alternative request will be needed to support the NRC Staffs review. Therefore, CP&L is withdrawing the referenced license amendment request.
