BRUNSWICK STEAM ELECTRIC PLANT, UNIT 1 - WITHDRAWAL OF AN AMENDMENT REQUEST (TAC No. ME1770)
Dear Mr. Waldrep:
By letter dated July 23,2009, Carolina Power & Light Company (the licensee) applied for an amendment to the Brunswick Steam Electric Plant (BSEP) Unit 1 Renewed Facility Operating License No. DPR-71. The proposed amendment would have revised the BSEP Unit 1 Technical Specification 5.5.12, "Primary Containment Leakage Rate Testing, Program," to add an exception for leakage testing associated with a modification being made to X-2 primary containment penetration sleeve at BSEP Unit 1.
During a conference call between the Nuclear Regulatory Commission (I\\lRC) staff and the licensee on September 3, 2009, it was apparent that post-modification leakage testing alternatives would more appropriately be sought as an alternative relief request in accordance with the requirements of Section 50.55a of Title 10 of Code of Federal Regulations rather than a license amendment request, and that additional technical information supporting an alternative request will be needed to support the NRC staffs review. Subsequently, by letter dated September 3, 2009, the licensee withdrew the amendment request.
The purpose of this letter is to advise that the above-cited application is being treated as withdrawn. Notice of Consideration of Issuance of the proposed amendment had not been published in the Federal Register.
