| Description | The NRC concluded that a willful violation of Title 10 of the Code of Federal Regulations (10 CFR) 73.55(k)(5)(iii) occurred on multiple occasions between 2012 and 2014, when two nuclear security officers at Columbia Generating Station were willfully inattentive while on duty, which resulted in their not meeting the requirement to be available at all times inside the protected area for their assigned response duties. As stated in the aforementioned preliminary agreement, Energy Northwest does not dispute this conclusion. In light of the significant corrective actions Energy Northwest had taken and subject to the satisfactory completion of the additional actions you have committed to take, as described in the Confirmatory Order, the NRC will not issue a Notice of Violation for the apparent violation discussed in NRC Inspection Report and Investigation Report to Energy Northwest dated June 25, 2015 (EA-14-240). The NRC is satisfied that its concerns will be addressed by making your commitments legally binding through a Confirmatory Order. As evidenced by your signed "Consent and Hearing Waiver Form" (Enclosure 2), dated September 21, 2015, you agreed to the issuance of this Confirmatory Order. |
