10 CFR 55.33 (b) states that if an applicants general medical condition does not meet the minimum standards under 55.33(a)(1), the Commission may approve the application and include conditions to accommodate the medical defect. Contrary to the above, one licensed operator stood watch in a TS position as Operator at the Controls on 19 different occasions between July 9 and August 30, 2007, without complying with a newly issued license condition to take prescribed medication while performing licensed duties. Because of the extenuating circumstances that resulted in the operator not being properly informed of the new restriction, compliance with his license was reasonably beyond his control. This finding is of very low safety significance because other licensed operators were available to man the controls and the restricted operator was under supervision at all times.
