Description

Title 10 of the Code of Federal Regulations (10 CFR) 50.74(c) requires, in part, that licensees shall notify the appropriate Regional Administrator within 30 days of a permanent disability of a licensed operator as described in 10 CFR 55.25. Contrary to the above, from 2009 to March 4, 2013, the licensee failed to notify the appropriate Regional Administrator when a licensed operator was diagnosed with a permanent disability. The licensee documented this issue in DA 50540600. This violation was determined to impact the regulatory process and was evaluated using Section 2.2.2 of the NRC Enforcement Policy. In accordance with Section 6.4.d of the NRC Enforcement Policy, this violation was determined to be a Severity Level IV violation because of the failure to report a medical condition that would have required a license restriction to maintain medical qualifications.
