Regulatory Basis; Reopening of Comment Period and Correction; 10 CFR Parts 30 and 70

On July 19, 2022, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (87 FR 42969) correcting a notice published in the Federal Register on April 28, 2022 (87 FR 25157), regarding a regulatory basis to support a rulemaking that would amend its regulations for decommissioning financial assurance for sealed and unsealed radioactive materials. This action is necessary to correct a publication issue with the regulatory basis. In the notification, the NRC solicited comments from the public, and the public comment period closed on June 27, 2022. The NRC has decided to reopen the public comment period to allow more time for members of the public to develop and submit their comments. The correction was effective on July 19, 2022. The comment period for the document published on April 28, 2022, has been reopened. Comments should be filed no later than August 18, 2022.

NMSS Staff Hosted a Public Meeting on the Diablo Canyon Site Decommissioning On July 21, 2022, the staff hosted a hybrid public meeting in the vicinity of the Diablo Canyon Nuclear Power Plant in San Luis Obispo, California to discuss the proposed post-shutdown decommissioning activities report (PSDAR). Approximately 90 members of the public participated in-person or via Teams, including representatives from the local Northern Chumash Tribe. Comments focused on seismic concerns, dose limits, spent fuel storage considerations, and the impacts of decommissioning waste removal from the site via barge. However, numerous comments were also supportive of the plant continuing operation and reinstating its previous request to renew the operating licenses, which will expire in 2024 (Unit 1) and 2025 (Unit 2). The staff addressed the questions raised during the meeting and the public comments captured in the transcript will be considered as part of the ongoing Diablo Canyon PSDAR review.
