Office of Nuclear Reactor Regulation (NRR)

Items of Interest Week Ending October 1, 2021 NRC Issues Notice of Enforcement Discretion for Seabrook Station On September 23, 2021, Region I approved a first-of-a-kind notice of enforcement discretion (NOED) request from NextEra for Seabrook Station, Unit 1 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21271A100). The NOED provides five days to allow time for NextEra to submit and for the NRC to review and disposition an emergency license amendment request to allow the plant to continue to operate with a cooling tower fan inoperable. The emergency amendment would avoid an unplanned shutdown approximately a week before the scheduled outage. Region I and NRR staff are in agreement that this is a low-risk configuration; in the unlikely event that the main circulating water tunnel from the Atlantic Ocean is unavailable, a mechanical draft evaporative cooling tower serves as the ultimate heat sink.

Transfer of Indian Point Project Management Responsibility Effective September 26, 2021, project management responsibility for Indian Point was transferred from NRR to the Office of Nuclear Material Safety and Safeguards for power reactor decommissioning. On September 23, 2021, the U.S. Nuclear Regulatory Commission (NRC) issued a notification letter to Holtec (ADAMS Accession No. ML21260A168), the Indian Point licensee, regarding the change in project management staff.

Karios Power Submits Application for Hermes Test Reactor On September 29, 2021, Kairos Power (Kairos) submitted the first part of a construction permit application for its 35-megawatt thermal Hermes test reactor to be located at a site near Oak Ridge, TN. The application contains the Preliminary Safety Analysis Report (PSAR) and some associated technical reports, which will be made public once a proprietary review has been completed. The staff will perform an acceptance review and plans to inform Kairos of the results within 60 days. Kairos intends to submit the environmental report as the second part of the application by the end of November 2021. Kairos has actively engaged in pre-application activities with the staff for several years, including a pre-application readiness audit of the PSAR. The Hermes will be a non-power reactor that will use TRISO fuel and a molten salt coolant and is an integral part of Kairos Powers technology development in support of a commercial nuclear power reactor.

Issuance of Update to Accident Tolerant Fuel Project Plan On September 30, 2021, the staff issued Version 1.2 of the Accident Tolerant Fuel (ATF)

Project Plan (ADAMS Accession No. ML21243A298). The ATF Project Plan describes the NRCs strategy to maximize our readiness to expeditiously review licensing actions for ATF, higher burnup, and increased enrichment fuel designs. The staff has engaged with industry and has made changes in the plan to streamline the document and better align with the industrys increased emphasis on higher burnup and increased enrichment fuels.

National Institute of Standards and Technology submits Restart Request On October 1, 2021, the National Institute of Standards and Technology submitted a restart request along with a set of corrective actions for the National Bureau of Standards Reactor (NBSR) (ADAMS Accession No. ML21274A018). The restart request initiates the NRC staff review of the corrective actions from the event on February 3, 2021, when the NBSR exceeded its cladding temperature safety limit. Per Title 10 Code of Federal Regulations, Section 50.36, Paragraph (c)(1), the reactor may not resume operations until authorized by the Commission if a safety limit is exceeded. This review complements the ongoing Special Inspection and will inform the NRCs decision on the restart of the facility.

Items of Interest Week Ending October 1, 2021 NRC Staff Held Public Meeting on Duane Arnold Decommissioning On September 28, 2021, NMSS and Region III held an in-person public meeting near the Duane Arnold site to receive comments on NextEra Energys Post-Shutdown Decommissioning Activities Report (ADAMS Accession No. ML20094F603). There were 15 attendees. A follow-up webinar will be held on October 6 to provide an additional opportunity for public comment.

List of Approved Spent Fuel Storage Casks: NAC International NAC-UMS Universal Storage System; Certificate of Compliance No. 1015, Amendment No. 8; Direct Final Rule; Confirmation of Effective Date; 10 CFR Part 72 [NRC-2021-0052; RIN 3150-AK63]

On September 30, 2021, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (86 FR 54031) confirming the effective date of October 19, 2021, for the direct final rule that was published in the Federal Register on August 5, 2021 (86 FR 42681).

This direct final rule amended the NRCs spent fuel storage regulations by revising the NAC International NAC-UMS Universal Storage System listing within the List of approved spent fuel storage casks to include Amendment No. 8 to Certificate of Compliance No. 1015. Amendment No. 8 revises the certificate of compliance to add the storage of damaged boiling-water reactor spent fuel, including higher enrichment and higher burnup spent fuel; change the allowable fuel burnup range; expand the boiling-water reactor class 5 fuel inventory that could be stored in the cask; and revise definitions in the technical specifications. The effective date of October 19, 2021, for the direct final rule published on August 5, 2021, is confirmed.

On October 1, 2021, the NRC published a notice in the Federal Register (86 FR 54341) amending its spent fuel storage regulations by revising the Holtec International HI-STAR 100 Cask System listing within the List of approved spent fuel storage casks to renew, for an additional 40 years, the initial certificate and Amendment Nos. 1, 2, and 3 of Certificate of Compliance No. 1008. The renewal of the initial certificate and Amendment Nos. 1, 2, and 3 revises the certificate of compliances conditions and technical specifications to address aging management activities related to the structures, systems, and components of the dry storage system to ensure that these will maintain their intended functions during the period of extended storage operations. The companion proposed rule was also published in the Federal Register on October 1, 2021 (86 FR 54410). This direct final rule is effective December 15, 2021.

Contract Awarded for Glass Panel Simulator On September 27, 2021, contract number 31310021C0023 was awarded to Corys Thunder, Inc.

in Jacksonville, FL. The purpose of this contract is to procure glass panel simulators which includes P&ID graphics, panel graphics, classroom glass panel simulator hardware, an associated maintenance environment, and maintenance support at the NRC Technical Training Center in Chattanooga, TN. The period of performance is from September 27, 2021, through September 26, 2026, with no option periods. The total potential value of the contract can be up to $985,400.00.

Contract Awarded for Small Business Program Help Desk and Outreach Support On September 28, 2021, contract number 31310021C0028 was awarded to Kingstonville, LLC in Bethesda, MD. The purpose of this contract is to obtain non-personal services for technical assistance to support staff with providing economic and business development services to small businesses and organizations interested in conducting business with the NRC. The period of performance is from October 1, 2021, through September 30, 2022, with four (4) option periods.

The total potential value of the contract can be up to $807,160.00.

Contract Awarded for Support and Development for Dosimetry Analysis and Computational Tools for Licensing and Inspections On September 27, 2021, contract number 31310021C0027 was awarded to Renaissance Code Development LLC in Corvallis, OR. The purpose of this contract is to assist the NRC with internal and external dosimetry analysis support for inspection, licensing, and emerging technology needs. Contract Awarded for Technical Assistance Support for the Civil Rights Program On September 27, 2021, contract number 31310021C0029 was awarded to Adnet/Accountnet, Inc. in Baltimore, MD. The purpose of this contract is to obtain technical assistance to support staff with support in processing complaints of discrimination filed against the NRC and requests for Alternative Dispute Resolution; and assistance in planning Equal Employment Opportunity training seminars and conferences. The period of performance is from September 30, 2021, through September 29, 2022, with four (4) option periods. The total potential value of the contract can be up to $781,732.80.

Items of Interest Week Ending October 1, 2021 Environmental Justice Team Hosted Virtual Public Meeting On September 27, 2021, the Environmental Justice Review Team held a virtual public meeting that consisted of two sessions: 1) a listening session to hear perspectives from environmental justice community leaders and practitioners on how the U.S. Nuclear Regulatory Commission (NRC) has addressed, and might enhance, environmental justice in its programs and activities; and 2) a panel discussion on the Commissions 2004 Policy Statement on the Treatment of Environmental Justice Matters in NRC Regulatory and Licensing Actions (69 FR 52040). This meeting was part of the staffs effort to engage with stakeholders representing a broad range of perspectives in response to Commission direction to conduct a systematic assessment of how agency programs, policies, and activities address environmental justice (SRM M210218B, April 23, 2021, ML21113A070). Approximately 250 participants joined the meeting.
