UNITED STATES OF AMERICA NUCLEAR REGULATORY COMMISSION BEFORE THE COMMISSION In the Matter of ENTERGY NUCLEAR OPERATIONS, INC., Docket Nos. 50-255-LT ENTERGY NUCLEAR PALISADES, LLC, 50-155-LT HOLTEC INTERNATIONAL, AND 72-007-LT HOLTEC DECOMMISSIONING 72-043-LT INTERNATIONAL, LLC (Palisades Nuclear Plant and Big Rock Point Plant)

NOTIFICATION The U.S. Nuclear Regulatory Commission Staff is filing this notification to inform the Commission and the participants in this matter that on May 9, 2022, the Staff issued a letter to Entergy Nuclear Operations, Inc. (ENOI) confirming that the Staffs December 13, 2021, order approving ENOIs license transfer application (LTA) regarding Palisades Nuclear Plant, Big Rock Point Plant, and their associated independent spent fuel storage installations remains valid and in effect as of the date issued. The Staff issued this letter in response to a January 21, 2022, update of the LTA by Holtec Decommissioning International, LLC (HDI).

On December 23, 2020, ENOI filed the LTA on behalf of itself, HDI, and others seeking approval, in part, to transfer ENOIs operating authority under the above-referenced licenses to HDI. In the LTA, ENOI stated that after the proposed transfer, Comprehensive Decommissioning International, LLC (CDI), a subsidiary of HDI, would become the decommissioning general manager for the sites. After the Staff approved the LTA but before the completion of the transfer, HDI, by letter dated January 21, 2022, updated the LTA to provide that HDI, not CDI, would become the decommissioning general manager for the sites. In its May 9, 2022, response to HDIs January 21, 2022, update of the LTA, the Staff explains that the updated information does not have an impact on the Staffs December 13, 2021, order approving the LTA and that, therefore, that order remains unchanged and effective as issued (i.e., effective for one year from the date of the order, with such date able to be extended by order upon written application and for good cause shown).
