NOTIFICATION THAT THE NRC STAFF IS NOT PARTICIPATING AS A PARTY

The U.S. Nuclear Regulatory Commission Staff is filing this notification, pursuant to 10 C.F.R.

§ 2.1316(c)(1), to inform the Atomic Safety and Licensing Board and the parties in this matter that the Staff does not desire to participate as a party in the captioned proceeding at this time.

Although a non-party, pursuant to 10 C.F.R. § 2.1316(b), the Staff will offer into evidence its safety evaluation associated with the license transfer application and provide one or more sponsoring witnesses. Additionally, the Staff will make disclosures as applicable to the Staff as a non-party or as agreed to with the parties. Finally, in response to the Commissions invitation,1 the Staff will submit, as a non-party and along with the submissions of the parties, its views on the applicability of the minimum formula regulation in 10 C.F.R. § 50.75(b) to the license transfer application.
