hereby responds to the State of New York's Motion Requesting Consideration of Additional Matters in Scheduling and Case Management Order (September 10, 2008) ("NYS Motion").

Riverkeeper supports the motion and requests that all of the relief requested by the State be granted to all parties, including Riverkeeper.

Riverkeeper believes the measures proposed by the State would enhance the efficiency of this proceeding, help parties who are co-sponsoring contentions to work together more effectively, and go far to ensure that the parties have a meaningful opportunity to participate in the decision-making process for the re-licensing of the Indian Point nuclear power plant.Given the parties' obligation to be timely in raising any new or amended contentions based on documents generated by the Nuclear Regulatory Commission

("NRC") Staff and Entergy Nuclear Operations Corporation

("Entergy"), Riverkeeper is especially concerned that the parties should be served contemporaneously with any meeting notices and copies of correspondence between Entergy and the Staff that are potentially related to the license renewal application and the NRC Staff s review of it. In JsPLT C- c addition to correspondence and meeting notices whose subject matter is designated as related to license renewal, the parties should also be copied with documents that are designated as related to the current operation and any other aspect of the plant's operation, in order to allow the parties to evaluate the potential relevance of the documents to license renewal. The parties should not be required to resort to searches of the NRC's Agency-wide Documents Access and Management System ("ADAMS")

to find relevant documents, because it may take several weeks after issuance before documents appear in ADAMS. In addition, important documents may be missed because the ADAMS document collection for a given docket number is not presented in chronological order.For instance, on August 14, 2008, Entergy sent to the NRC Staff a document which appears to constitute a license amendment, even though it was not given a license amendment number. See Letter from Entergy to NRC, Additional Information Regarding License Renewal Application -Structural OE Clarifications, Clarifications for Electrical RAIs and Audit Questions, License Renewal Application Amendment, ADAMS Accession#ML082350071.

The letter was not sent to the parties to the Indian Point proceeding, and it was not posted to ADAMS until September 2, 2008, three weeks after it was issued. See Attachment 1, where the letter is listed as item # 4.
