.) November 17, 2008 APPLICANT'S BOARD NOTIFICATION CONCERNING COMPLETION OF INDIAN POINT UNIT 1 SPENT FUEL POOL REMEDIATION ACTIVITIES Entergy Nuclear Operations, Inc. ("Entergy") hereby notifies the Atomic Safety and Licensing Board ("Board") that Entergy has completed remediation activities for Unit I of the Indian Point Energy Center ("IPEC") in accordance with certain commitments made by Entergy to the NRC earlier this year.' Specifically, on November 5, 2008, Entergy notified NRC Region 1 as follows:
[Entergy] [has] completed the draining and de-sludging of the Unit 1 fuel pools. The fuel has been safely removed from the west pool (as of 9/19/08), the fuel pools are drained (as of 10/15/08) and de-sludge operations are completed (10/31/08). As an added measure for long-term SAFSTOR maintenance the most contaminated (west pool) has had a fixative (coating) applied to minimize the potential for future airborne contamination (this was completed today). This ends an important project for IPEC which has terminated the leakage from the Unit 1 spent fuel pools thus stopping the introduction of radiological contaminants to the underlying groundwater from this source. The contamination of ground water as a result of an actively leaking pool complex at Unit I has been terminated.
Entergy is providing this notification in accordance with its obligation to inform the Board, within a reasonable period of time, of new information that may be relevant and material to the See Letter from Joseph E. resolution of an admitted contention. 3 Specifically, on August 11, 2008, Entergy filed a motion pursuant to 10 C.F.R. § 2.323(e) asking the Board to reconsider its decision to admit Consolidated Contention Riverkeeper EC-3/Clearwater EC- 1 ("Consolidated Contention"), 4 which alleges that Entergy has not adequately assessed the significance of new information concerning the potential environmental impacts of radionuclide leaks from spent fuel pools located at the IPEC site. 5 The Board's decision on Entergy's Reconsideration Motion is pending. Among other things, Entergy sought reconsideration (or, alternatively, clarification of the scope) of the Consolidated Contention insofar as the contention may raise issues related to the "history of leakage" from the IPI spent fuel pools. 6 In support of its request, Entergy-explicitly citing the commitments contained in NL 079-stated that "the IP1 pool will be emptied and drained by the end of 2008, and thus cease to be a source of leakage well before the period of extended operation."7 See Sacramento Mun. Util. Dist. (Rancho Seco Nuclear Generating Station), CLI-93-5, 37 NRC 168, 170 (1993) (citing Duke Power Co. (William B. McGuire Nuclear Station, Units I and 2), ALAB-143, 6 AEC 623, 625 (1973)) (noting obligation to keep the Licensing Board and other parties informed of relevant and material new information); VirginiaElec. and Power Co. (North Anna Nuclear Power Station, Units I & 2), ALAB-551, 9 NRC 704, 710 (1979) (stating that the notification should identify the possible relationship between the document and issues open before the Board, including the issue and its bearing on the facility in question).
