Duetospecificcircumstances currently existingattheDonaldC.CookNuclearPlantUnit2,wearerequesting anemergency changetothesubjectTechnical Specification (T/S).Currently T/S3.8.2.3requirestwoOPERABLE250voltD.C.batteries inMODES12,3,and4.Surveillance Requirement 4.8.2.3.2.e. requiresOPERABILITY tobedemonstrated byverifying atleastonceper60months,thatthebatterycapacityisatleast80%ofthemanufacturer's ratingwhensubjected toaperformance discharge test.Therequiredcapacitydischarge testwasperformed onbattery"AB"onMay16,1984andonbattery"CD"onMay10,1984.Battery"CD"passedthe60monthtest.Battery"AB"didnotpassthe60monthtest.Ourperformance discharge testisrunfor6.4hours(corrected fortemperature). Thecapacityofthebattery"AB"droppedbelow80%afterapproximately fivehoursandthirtyminutes.Basedonourengineering reviewandacceptable T/Ssurveillance testing,battery"CD"hasadequatecapacitytocarryallofit'semergency loadsforafull6.4hourperiod.Wearerequesting thesubjectT/Sbeamendedtoallowoperation inMODES4and3withonefullyOPERABLEbattery.Thisamendment wouldallowustoperformactivities thatarerequiredintheseMODESpriortostartupafterrefueling. OnceasecondfullyOPERABLEbatteryisinplace,thisamendment willnolongerbeneeded.Basedonourcurrent,bestestimate, theproposedchangeisneededbyJune13,1984inordertopreventcommensurate day-for-day delaysinstartupoftheUnit.Unit2iscurrently comingoutofarefueling outage.InthatwehavebeenshutdownsinceMarch10,1984thecoreisrelatively clean(i.e.,freeofactiveparticulate) andsufficiently boratedtomaintainsubcriticality atcoldconditions. Decayheatissignificantly reduced,becauseofthelongdecaytimeperiodsincecriticaloperation andthefactthat92outof193assemblies havebeen840gpjpg"DRADOOOaqoOCRP>0003/+. PDR I~~~~'Jlhi're'44')'.'I)JQrel)ehhJII0~~rrh)h,~~',If'rI*I)HII*I'e)h vMr.HaroldR.on~/AEP:NRC:0893 replacedwithfreshfuel.Sincetheplantisatrefueling boronconcentration inMODES3and4,thepotential forgoingcriticalisminimal.Further,intheeventofanaccidentrequiring decayheatremovalusinge'mergency systems,decayheatisatlevelsnormallyassociated withMODES5and6ratherthanhighermodes.Basedontheabovesafetyconsiderations, webelieveoperation inMODES4and3,afterrefueling andwithonlyonefullyOPERABLEbattery,willnotcreateasignificant hazardsconsideration asdefinedin10CFR50.92.Specifically, webelievethattheproposedchangewillnotincreasetheprobability orconsequences ofapreviously-analyzed accident. Thechangemayreduceinsomewayasafetymargin,butitisclearlywithintheacceptance criteriaformaintaining thecoresubcritical, andmaintaining decayheatremovalcapability fornormalandaccidentconsiderations inMODES3and4.Inaddition, sincetheproposedchangedoesnotincreasetheconsequences ofapreviously analyzedaccident, thechangewillnotadversely impacttheenvironment. TheAttachment tothislettercontainstheproposedrevisedT/Spage.Thechangeisindicated byverticalbarsdrawnontherighthandmarginofthepage.TheproposedchangehasbeenreviewedbythePlantNuclearSafetyReviewCommittee andwillbereviewedbytheNuclearSafetyandDesignReviewCommittee at,itsnextscheduled meeting.Pursuant. totherequirements of10CFR50.91(b)(1), acopyofthisletteranditsattachment havebeentransmitted toMr.R.C.CallenoftheMichiganPublicServiceCommission. Inaddition, commensurate withtheaffectthatanemergency T/Schangehasonthenoticeandpublication periodintheFederalRegister, wewillnotifytheStateofMichiganbytelephone ofthisrequested amendment toourT/S.Weinterpret thisapplication foralicenseamendment toconstitute aClassIIIAmendment asdefinedin10CFR170.22.Therefore, acheckintheamountof$4000.00willbeforwarded inthenearfutureaspaymentforprocessing theaforementioned request.Thisdocumenthasbeenpreparedfollowing Corporate procedures whichincorporate areasonable setofcontrolstoinsureitsaccuracyandcompleteness priortosignature bytheundersigned.
