ThisletteranditsattachmentsconstituteanapplicationforamendmenttotheTechnicalSpecifications(T/Ss)forDonaldC.CookNuclearPlantUnits1and2.Specifically,weareproposingtomodifyT/Ss3/4.6.1.2byremovingthespecificschedulingrequirementsforTypesA,B,andCtests(overallintegratedandlocalcontainmentleakagerate)fromtheT/SsandreplacingtheserequirementswitharequirementtoperformTypesA,B,andCtestinginaccordancewithAppendixJto10CFR50.TheproposedamendmentwillprovidetheflexibilityneededinschedulingTypeAtestsinconsiderationofour18-monthfuelcycles.Further,theproposedamendmentwillallowustomoretimelyimplementanyperformancebasedinspectioncriteriathatmaybeaddedtoAppendixJasanoptiontoexistingcriteria.Itisourunderstandingthatsuchregulatoryreliefmaybeissuedasafinalrulechangeasearlyas1995.Theproposedchangestotheschedulingrequi.rementsareconsistentwiththesurveillancerequirementsfor10CFR50,AppendixJtestinginNUREG-1431,"StandardTechnicalSpecificationsWestinghousePlants."Attachment1providesadetaileddescriptionoftheproposedchanges,thejustificationforthechanges,andourdeterminationofnosignificanthazardsconsiderationperformedpursuantto10CFR50.92.Attachment2containstheexistingT/Spagesmarkedtoreflecttheproposedchanges.Attachment3containstheproposedT/Spages.CC\9407250158940719JL rE~h'\

W.T.Russell-2-AEP:NRC:1215TheproposedamendmentisaCostBeneficialLicensingAction(CBLA).TheproposedamendmentcaneliminateatleastoneTypeAtestperunitduringeach10-yearserviceperiod.TypeAtestsaddatleasttwotothreedaystoeachoutage.Italsocostsapproximately$200,000toperformaTypeAtest.ThelifetimecostsavingsassociatedwiththisCBLAisapproximately$800,000basedontworemaining10-yearserviceperiodsforeachunit.AnotheroptionwouldbetorequestanexemptiontoAppendixJrequirementsever'ytimethissituationwouldoccur.Suchexemptionshavebeengrantedtootherutilitiesinthepast,however,approvalofthisproposedamendmentwouldprecludeadditionalstaffreviewactivitiesinthefuturefornumerousexemptionrequests.Webelievetheproposedchangeswillnotresultin(1)asignificantchangeinthetypesofanyeffluentthatmaybereleasedoffsite,or(2)asignificantincreaseinindividualorcumulativeoccupationalradiationexposure.TheseproposedchangeshavebeenreviewedbythePlantNuclearSafetyReviewCommitteeandtheNuclearSafetyandDesignReviewCommi.ttee.Incompliancewiththerequirementsof10CFR50.91(b)(l),copiesofthisletteranditsattachmentshavebeentransmittedtotheMichiganPublicServiceCommissionandtot'eMichiganDepartmentofPublicHealth.Thisletterissubmittedpursuantto10CFR50.30(b)and,assuch,anoathstatementisattached.IndianaMichiganPowerrequestsNRCapprovaloftheproposedamendmentbyAugust1995,sothatanadditionalexemptionrequestwouldnothavetobefiledforCookNuclearPlantUnit2.BasedontheprescriptiveT/Ssurveillancerequirementsthatcurrently'exist,theexemptionrequestwouldhavetobefiledtokeepfromperformingaTypeAtestinUnit2foreachoftwosubsequentrefuelingoutages,thefirstofwhichistentativelyscheduledtobegininFebruary1996.Sincerely,O'E'DE.FitzatrickVicePresident Attachment1toAEP:NRC:1215Page2monthintervals.Theinitialschedulewasbasedon12-monthfuelcycles;however,18-monthfuelcyclesareusedmorewidelythroughouttheindustryandalsoatCookNuclearPlant.ExperienceatotherunitshasdemonstratedthatthecurrentT/Sstestintervalistooprescriptive.AttheNorthAnnaPowerStation,whichuses18-monthcycles,bothunitshadtosubmitrequestsforaonetimeT/Ssexemptionrequest,todeviatefromtheT/SswhichspecifiedaTypeAtestschedule,toallowthethirdtesttocoincidewiththe10-yearinserviceinspectionperiod.ArizonaPublicServiceCompanyalsosubmittedasimilaramendmentrequestonDecember2,1993,torewordtheirT/Ssasproposedherein.ThissubmittalwassubsequentlyapprovedbytheNRConApril6,1994,forthePaloVerdeNuclearGeneratingStationUnits1,2,and3.TheneedforschedulingflexibilityforTypeAtestswasalsoincorporatedaspartoftheT/SsImprovementProgramand,asaresult,NUREG1431,"StandardTechnicalSpecificationsWestinghousePlants"onlyreferencesAppendixJto10CFR50requirementsforTypeAtests.WearealsoapplyingthissamereasoninginthisrequestforTypesBandCtestingrequirementstoonlyspecifyreferencetoAppendixJof10CFR50forschedulingrequirements.The24monthtestintervalisarequirementofAppendixJto10CFR50.TheCookNuclearPlantT/SscurrentlyrequirethatasetofthreeTypeAtestsbeperformedspecificallyat40a10monthintervalsduringeach10-yearserviceperiod,withthethirdtestofeachsetperformedduringtheshutdownforthe10-yearplantinserviceinspection.Tomeettheserequirements,aplantoperatingonan18-monthfuelcyclemustperformaTypeAtesteveryotheroutage.Thesurveillanceintervalisnogreaterthan24monthsforTypesBandCtests,whichisthesameasprescribedinAppendixJto10CFR50.AppendixJto10CFR50requiresthataTypeAtestofthecontainmentbeperformedperiodically.Thesetestsarerequiredtobescheduledasasetofthreetests,tobeperformedatapproximatelyequalintervals,duringeach10-yearserviceperiod,withthethirdsettocoincidewiththeshutdownforthe10-yearplantinserviceinspection.WhiletheCookNuclearPlantT/SsessentiallyduplicatetherequirementsofAppendixJto10CFR50,theT/SscontaintheadditionalrequirementthatTypeAtestingbeperformedat40a10monthintervals.Thisadditionalrequirementistoorestrictiveforunitswith18-monthfuelcycles,asindicatedabove,andoftentimesrequiressubmittalofanexemptionrequesttoexceedthe40a10monthlimitforthethirdtest.Therefore,weproposetorevisetheT/SsforCookNuclearPlantUnits1and2todeletetheprescriptivetestingandschedulingrequirementsforTypesA,B,andCtestingandinsteadreferencethatTypesA,B,and Attachment1toAEP:NRC:1215Page3Ctesting10CFR50.wordingin4.6.1.2.a,willbeperformedinaccordancewithAppendixJtoThisisaccomplishedbymodifyingtheprescriptiveT/Ss4.6.1.2.aand4.6.1.2.dandcombiningthemintoT/SsanddeletingT/Ss4.6.1.2.b,4.6.1.2.c,and4.6.1.2.f.Unit1T/SsdonothavearequirementthatexemptTypesA,B,andCtestingfromtheprovisionsofT/S4.0.2.T/S4.0.2providesprovisionstoallowamaximumallowablesurveillanceintervalextensionofupto25%ofthespecifiedsurveillanceinterval.TherequirementsofAppendixJto10CFR50wouldbeviolatedifthisextensionwereusedforUnitl.Unit2T/Sshavethisrequirementalreadyincorporated.TherequirementisbeingaddedtoUnit1toprovideconsistencybetweentheT/SsofbothunitsandalleviatethepossibilityofviolatingtherequirementsofAppendixJ.ApprovalofthisproposedchangewouldalsoreducethenumberT/Samendmentrequestsinthefuture,thatwouldberequiredasaresultoftheanticipatedimprovementsbeingconsideredforAppendixJto10CFR50,andwouldgiveustheflexibilitytoimplementanyenhancementssooner.ByonlyreferencingAppendixJintheT/Ss,anychangestoAppendixJwouldautomaticallybeencompassedwithintheT/Ss.III.10CFR5092CRITERIPer10CFR50.92,aproposedchangedoesnotinvolveasignificanthazardsconsiderationifthechangedoesnot:involveasignificantincreaseintheprobabilityorconsequencesofanaccidentpreviouslyevaluated,2.createthepossibilityofanewordifferentkindofaccidentfromanyaccidentpreviouslyevaluated,or3.involveasignificantreductioninamarginofsafety.Criterion1ThisamendmentrequestdoesnotinvolveasignificantincreaseintheprobabilityorconsequencesofanaccidentpreviouslyevaluatedbecausetheproposedchangestotheT/Ssdonotaffecttheassumptions,parameters,orresultsofanyUFSARaccidentanalysis.Theproposedchangesdonotmodifytheresponseofthecontainmentduringadesignbasisaccident.Theproposedamendmentdoesnotaddormodi.fyanyexistingequipment.TheproposedTypesA,B,andCtestingscheduleswillbeconsistentwithAppendixJto10CFR50.Basedontheseconsiderations,itisconcludedthatthechangesdonotinvolveasignificantincreaseintheprobabilityorconsequencesofanaccidentpreviouslyevaluated.

Attachment1toAEP:NRC;1215Page4Criterion2Theproposedchangesdonotinvolvephysicalchangestotheplantorchangesinplantoperatingconfiguration.TheproposedchangesonlyremovetherestrictiveschedularrequirementsforconductingTypeAtestingfromtheT/SsandsubstitutetheschedulespecifiedinAppendixJto10CFR50.ForTypesBandCtestingtheschedularrequirementsareremovedfromT/Ssbecausetheyarealreadyspeci.fiedinAppendixJto10CFR50.Thus,itisconcludedthattheproposedchangesdonotcreatethepossibilityofanewordifferentkindofaccidentfromanyaccidentpreviouslyevaluated.Criterion3ThemarginforsafetypresentlyprovidedisnotreducedbytheproposedchangeintheschedularrequirementsforTypeAtests.TypesBandCschedularrequirementsarenotchangedbyremovingthemfromT/Ss.AlthoughthechangesallowmoreflexibilityinschedulingTypeAtests,theproposedamendmentcontinuestoensurereactorcontainmentsystemreliabilitybyperiodictestinginfullcompliancewith10CFR50,AppendixJ.Basedontheseconsiderations,itisconcludedthatthechangesdonotinvolveasignificantreductioninamarginofsafety.
