MEMORANDUM AND ORDER (Scheduling Initial Prehearing Conference (amended)) 1

This Licensing Board will hold an initial prehearing conference in this license renewal

proceeding on Monday, May 20, 2024 beginning at 1:00 p.m. Eastern Standard Time (EST) to

hear oral argument on the issues presented in the March 28, 2024 hearing request of Beyond

Nuclear, Inc. (Beyond Nuclear) and the Sierra Club, Inc. (Sierra Club). Below are details on

information technology and administrative matters relevant to the conduct of the conference.

A. Information Technology Matters

The oral argument will be held in-person in the Atomic Safety and Licensing Board

Panels Hearing Room at NRC Headquarters, 11545 Rockville Pike, Rockville, MD, 20852. The

participants and members of the public who wish to attend should plan to arrive about an hour

before the conference, entering NRC Headquarters through the One White Flint North Building,

to allow enough time to proceed through security and to be escorted to the Hearing Room.

The Board will issue a separate order the week before the oral argument with a listen-

only telephone number for members of the public and other interested persons. The argument

will also be transcribed, and the transcript will promptly be placed in the NRCs electronic

hearing docket, where it may freely be accessed.

B. Administrative Matters

The oral arguments primary purpose is to allow the Board to ask questions and obtain

answers concerning whether the petitioners th ree proffered contentions are admissible under

10 C.F.R. § 2.309(f)(1). The Board will hear from counsel for Beyond Nuclear and Sierra Club,

counsel for Virginia Electric and Power Company, and counsel for the Nuclear Regulatory

Commission Staff.

Because the oral argument is not an evidentiary hearing, the participants should not

attempt to introduce evidence during the argument. Consequently, material that has not already

been cited in the participants pleadings should not be used.

On or before noon EST on Tuesday, May 14, 2024, each of the participants should

provide the Boards law clerk, Emily Newman (emily.newman@nrc.gov), with an e-mail

specifying the name or names of counsel who will be making a presentation on behalf of that

participant.
