MEMORANDUM AND ORDER (Granting Motion for Extension of Time and Postponing Oral Argument)

This proceeding concerns the twenty-year subsequent renewal of the licenses for North

Anna Power Station Units 1 and 2, which currently authorize Virginia Electric and Power

Company (VEPCO) to operate North Anna Power Station, Units 1 and 2, located in Louisa

County, Virginia, until, respectively, April 1, 2038 and August 21, 2040. On January 8, 2024, a

notice was published in the Federal Register announcing the opportunity to request a hearing

on the draft site-specific environmental impact statement issued by the Nuclear Regulatory

Commission Staff (NRC Staff).1 Beyond Nuclear, Inc. (Beyond Nuclear) and the Sierra Club,

Inc. (Sierra Club) (collectively Petitioners) submitted a hearing request through the agencys E-

Filing system on March 28, 2024. 2 On April 3, 2024, this Licensing Board was established to

rule on standing and contention admissibility matters and to preside at any hearing. 3

Subsequently, on May 13, 2024, Petitioners filed an emergency motion for extension of

time of one-week to reply to the answers filed by VEPCO and the NRC Staff in opposition to

Petitioners amended hearing request and petition to intervene and to request a postponement

of oral argument until sometime during the first two weeks of June. 4 Petitioners counsel states

that the extensions are needed for medical reasons. 5 This motion is unopposed by both VEPCO

and the NRC Staff.6

For good cause shown, the Board grants the Petitioners motion to extend the deadline

to file their reply. The reply is now due Monday, May 20. The Board will also reschedule oral

argument in this proceeding for Monday, June 3, at 1:00PM ET.
