ENVIRONMENTAL ASSESSMENT AND FINDING OF NO SIGNIFICANT IMPACT RELATED TO EXEMPTION REQUEST FOR HI-STORM FW MPC STORAGE SYSTEM CONTINUOUS BASKET SHIM CANISTERS AT LIMERICK GENERATING STATION UNITS 1 AND 2 INDEPENDENT SPENT FUEL STORAGE INSTALLATION

Dear Christian Williams:

The staff has issued the environmental assessment and Finding of No Significant Impact related to your application for an exemption dated April 5, 2024 (Agencywide Documents Access and Management System Accession Number No. ML24096A137). The proposed action would allow Constellation to load and maintain loaded MPC-89-CBS in the HI-STORM FW MPC Storage System at the Limerick Generating Station Units 1 and 2 Independent Spent Fuel Storage Installation in the storage condition where the terms, conditions, and specifications in CoC No. 1032, Amendment No. 1, Revision No. 1 are not met, solely as it applies to the three already loaded and the near-term planned loading of five non-compliant CBS canisters beginning in August 2024. This action, if approved, would be permitted under exemption from Title 10 of the Code of Federal Regulations (10 CFR) Part 72, sections 72.212(a)(2); 72.212(b)(3); 72.212(b)(5)(i); 72.212(b)(11) and 72.214.
