DRAFT SAFETY EVALUATION FOR HI-2210161, REVISION NO. 4, TOPICAL REPORT ON THE RADIOLOGICAL FUEL QUALIFICATION METHODOLOGY FOR DRY STORAGE SYSTEMS (CAC: A33009, DOCKET NO. 72-1014, EPID:

L-2021-LLT-0003)

Dear Kimberly Manzione:

By letter dated May 31, 2021, as supplemented on August 18, 2021; February 7, 2022; February 1, 2023, and April 14, 2023, Holtec International (Holtec) submitted for U.S. Nuclear Regulatory Commission (NRC) staff review the Topical Report (TR) HI-2210161, Revision No. 4 Topical Report on the Radiological Fuel Qualification Methodology for Dry Storage Systems.

Based on its review of the information submitted in the TR, the NRC staff finds the TR is acceptable for referencing subject to the limitations specified in the TR, and in the NRC safety evaluation (SE).

A copy of the draft SE is attached to this letter. If Holtec provides comments, those comments should be provided within 30 days of the date of this letter. The NRC staff will exercise its discretion on whether to address those comments. If you are unable to meet this deadline, please notify us in writing, at least one week in advance with the reasons for the delay. The NRC staff will then assess the impact to finalize the SE and notify you of a revised schedule.

Your response must be via a letter from an authorized individual. In addition, please provide an electronic redline/strikeout Microsoft Word version of the SE. It helps expedite the NRC staff response to comments if Holtec provides a formal transmittal and a separate Microsoft Word file with a table including the following columns: Comment No., Page No., Line No., Comment Type (i.e., clarity, accuracy, etc.), Suggested Revision, and a blank column NRC Disposition.

However, Holtec may provide its comments in any format it chooses. The final SE will be issued after making any necessary changes.

Note that at this stage of the process, the NRC staff has completed its review of the submitted information and does not seek technical arguments. The staff conclusions and conditions will not change unless new information is provided that was not available during our review. If Holtec would like to discuss the draft SE in detail, we can do so in a noticed public meeting.

K. Manzione Both this letter and the draft SE have been placed in ADAMS and made Official Agency Records. The draft SE is declared as public because it does not contain any proprietary information. This letter is also declared public.
