By letter dated May 31, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession Package No. ML21152A257), as supplemented on August 18, 2021 (ML21230A336), February 7, 2022 (ML22038A940), February 1, 2023 (ML23032A449), and April 14, 2023 (ML23104A377), Holtec International (Holtec) submitted for U.S. Nuclear Regulatory Commission (NRC) staff review the Topical Report (TR) HI-2210161, Revision No. 4 Topical Report on the Radiological Fuel Qualification Methodology for Dry Storage Systems.

The NRC staff has found the TR acceptable for incorporation in a certificate of compliance (CoC) application (i.e., for an initial application or an amendment) to the extent specified and under the limitations delineated in the TR and in the enclosed final safety evaluation (SE), which defines the basis for our acceptance of the TR.

Our acceptance applies only to material provided in the subject TR. We do not intend to repeat our review of the accepted material described in the TR. When the TR appears as a reference in a CoC application, our review will ensure that the material presented applies to the specific storage cask system involved. CoC applications that deviate from this TR will be subject to a cask-specific review in accordance with applicable review standards.

If future changes to the NRC's regulatory requirements affect the acceptability of this TR, Holtec will be expected to revise the TR appropriately and resubmit the revised report for review.

Following NRC review and acceptance of a revised TR, Holtec will be expected to incorporate the revised TR through a CoC amendment. Alternatively, any CoC holders referencing this existing TR would be expected to justify its continued applicability.

In accordance with the guidance provided on the NRC website, we request that Holtec publish an accepted version of the TR within three months of receipt of the date of this letter. The accepted version shall incorporate this letter and the enclosed SE after the title page. Also, the accepted version must contain all historical review information, and shall include

K. Manzione an "-A" (designating accepted) following the TR identification symbol. NRC staff will confirm the contents of the -A TR, and as appropriate, will issue a verification letter, at which point the TR may be referenced in CoC applications.
