Rulemaking for a site-specific analysis or performance assessment for the Purpose disposal of depleted uranium and other long-lived isotopes in a near-surface disposal facility.

  • In SECY-20-0098, the NRC staff recommended to the Commission that this rulemaking and the rulemaking to promulgate requirements for the near-surface disposal of greater-than-Class C (GTCC) waste (GTCC waste Key rulemaking) be consolidated and integrated into one proposed rule as these Information two rulemaking efforts would both amend 10 CFR Part 61 and have related proposed requirements. The recommendation to consolidate is based on based on expected cost savings, consideration of stakeholder input, and efficiencies.

Codify the post 9/11 security orders within Title 10 of the Code of Federal Purpose Regulations (10 CFR) Part 73 that govern the security for special nuclear material at fixed sites.

  • Make generically applicable security requirements similar to those imposed by security orders issued following the terrorist attacks of September 11, 2001.
  • Improve consistency and clarity.
  • Use a risk-informed and performance-based structure.
  • In April 2016, the Commission directed the NRC staff to suspend efforts on the Enhanced Security of SNM rulemaking. In August 2018, the Commission Key directed the staff to resume rulemaking with the exclusive scope of codifying Information the post 9/11 security orders.

This rulemaking will: (1) implement NRC's authority under the new section 161A of the Atomic Energy Act of 1954 (AEA), as amended, for access to enhanced weapons and associated firearms background checks; (2) modify physical security Purpose event notifications; add requirements for reporting suspicious activities at power reactor facilities, reactor Independent Spent Fuel Storage Installations, and Category I strategic special nuclear materials facilities.

  • These proposed regulations are consistent with the provisions of the Firearms Guidelines the NRC published under section 161A with the approval of the U.S.

Attorney General on June 25, 2014 (79 FR 36100).

  • The final rule was sent to the Commission in May 2018.

3BPart 73: Proposed Rule - Cybersecurity at Fuel Cycle Facilities (RIN 3150-AJ64; NRC-2015-0179)

The Commission directed the U.S. Nuclear Regulatory Commission (NRC) staff to proceed with a proposed rulemaking to implement cyber security into Part 73 for Purpose certain fuel cycle facilities. The Commission directed the rulemaking to be a high priority, expedited rulemaking that uses a graded, consequence based regulatory approach and is informed by industrys voluntary efforts.

  • The NRC staff published SECY-14-0147, Cyber Security for Fuel Cycle Facilities, in December 2014, which proposed three options to implement cyber security. These options included orders, rulemaking, or continuation of voluntary initiatives.
  • The Commission provided SRM-SECY-14-0147, Staff Requirements - SECY-14-0147 - Cyber Security for Fuel Cycle Facilities in March 2015, which directed the NRC staff to proceed with rulemaking.
  • The NRC published the Regulatory Basis and Comment Resolution document for the cyber security proposed rulemaking on March 3, 2016 (ML15355A461).
  • The NRC staff provided draft proposed rule language (ML16131A115) for discussion at a public meeting on May 19, 2016.

4BDecommissioning Financial Assurance for Sealed and Unsealed Radioactive Material (PRM-30-66; NRC-2017-0159)

Amend NRC regulations to add radionuclides and corresponding possession values not currently listed in 10 CFR Part 30 Appendix B for calculating a licensees decommissioning funding requirement to possess a radionuclide with a half-life greater than 120 days. It would also apply a uniform and more risk-Purpose informed method for setting possession values for all radionuclides listed in Appendix B. The rulemaking will apply to all entities, including those in Agreement States, licensed to possess sealed or unsealed byproduct or special nuclear material with a half-life greater than 120 days.

5BAlternatives to the Use of Credit Ratings (RIN 3150-AJ92)

Amend NRC regulations to remove any use or reference to bond rating, as mandated by the Dodd-Frank Act of 2010. The rule would develop alternate criteria, if any, to replace bond rating criteria. The purpose is to ensure financial Purpose tests are sufficient when evaluating decommissioning financial assurance. The scope of this rulemaking would affect all NRC's regulations referring to bond rating. The rulemaking was formerly titled "Dodd-Frank Act of 2010."

The NRC is currently implementing two Commission-directed rulemaking activities, which are in different stages: (1) the 10 CFR Part 61 low level radioactive waste disposal rule, and (2) development of a regulatory basis for the disposal of Greater-Than-Class-C (GTCC) waste rule. As these two Purpose rulemaking efforts would both amend 10 CFR Part 61 and have related proposed requirements, the NRC staff recommended to the Commission that they be consolidated and integrated into one proposed rule based on expected cost savings, consideration of stakeholder input, and efficiencies.

  • The Commission directed the staff to make certain substantive revisions to the draft final rule and to publish it as a supplemental proposed rule.
  • A draft regulatory basis for the disposal of GTCC waste was issued in the Federal Register on July 22, 2019 (84 FR 35037).

This rulemaking would address knowledge gained in scientific and technical advances and affect the package design requirements and transportation of radioactive material.

In addition, the RIC offers an environment to interact with nuclear industry leaders and share ideas, perspectives, and experiences on matters related to nuclear safety and regulation.

  • The staff created a working group to lead and execute this effort.
  • Starting on April 26, 2019, the NRC staff issued a charter for building a smarter fuel cycle licensing program, and directed the established Working Group, to seek and evaluate input from stakeholders (ML19115A011).
  • On April 30, 2020, the NRC staff issued a report that included Key recommendations for addressing the collected suggestions from both internal Information and external stakeholders (ML20099F354).

Guidance for material control and accounting at fuel cycle facilities that possess Purpose special nuclear material of moderate strategic significance (Category II facilities).

  • NRC issued draft NUREG-2159, Acceptable Standard Format and Content for the Fundamental Nuclear Material Control Plan Required for Special Nuclear Material of Moderate Strategic Significance, in 2013 in anticipation of a planned rulemaking for 10 CFR Part 74, Material Control and Accounting of Special Nuclear Material. The draft was written to the proposed revisions of Key Part 74.

Information

  • The Commission terminated the rulemaking in 2019, and the draft NUREG-2159 was not finalized.
  • The NRC staff is currently revising the draft consistent with the existing requirements of 10 CFR Part 74.
  • The revised draft will be issued in July 2021 for a 60-day public comment period. Final document to be issued in the fall of 2021.

  • 2019 - 2020: Office of Nuclear Reactor Regulation (NRR) led an effort on LSSI resolution o Provided approach and recommendations (subsequently approved by NRR Office Director) on approach to address these issues o Implemented concept and used a handful of times o NMSS representative on NRR team determined that the concept could also apply in NMSS with some modifications Identified activities pursuing similar intent over multiple business lines
  • NMSS working team formed with staff across business lines and with regional inspectors to share insights on implementing a consistent approach while recognizing differences in business lines
