U.S. Nuclear Regulatory Commission Public Meeting Summary February 12, 2021

Title:

Public Meeting to Discuss the Alternatives to the Use of Credit Ratings Advance Notice of Proposed Rulemaking Date: February 8, 2021 Location: Webinar Category: Category 3 Purpose of the Meeting: The purpose of this meeting was to discuss the U.S. Nuclear Regulatory Commissions (NRC) advance notice of the proposed rulemaking (ANPR) for the Alternatives to the Use of Credit Ratings and request for stakeholder input.

General Details: The meeting was attended by 19 NRC staff and 29 members of the public.

Summary of NRC Presentation: The NRC staff presented an analysis of the Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010 (Dodd-Frank Act) and its impact to NRC regulations. The staff also provided background on the NRCs Decommissioning Funding Assurance Requirements and the use of credit ratings. The staff discussed the proposed approaches for implementing the requirements of the Dodd-Frank Act, the rulemaking timeline, and the history.

Summary of Public Feedback: Participants included representatives from the Nuclear Energy Institute (NEI); the law firm of Morgan, Lewis & Bockius; Westinghouse Electric Company; and Exelon. Participants expressed their appreciation for the opportunity to meet to discuss the potential rulemaking and to ask questions about the ANPR. An NEI representative stated that NEI is in the process of developing a complete set of comments for submittal.

Action Items/Next Steps:

The staff will consider, to the extent possible, public feedback received to inform the development of the proposed rule and associated guidance.
